Brief Summary of Substitute Bill

$The limitation on the number of projects that may be developed under the Public‑Private Initiatives Act (PPI) is removed.

$A legislative oversight committee is formed to study and make recommendations on the future of the PPI program.

Background:

In 1993 the Legislature enacted the Public‑Private Initiatives Act (PPI).  The act directed the Department of Transportation (DOT) to develop up to six demonstration projects to use the private sector to undertake projects on behalf of the DOT.  The original allocation of six projects has been utilized.  No further PPI  projects can be pursued under current law.

 In 1995 the PPI Act was amended to require the formation of a local involvement committee and an advisory election on a proposed project if a petition bearing at least 5000 signatures of persons opposing the project was submitted to the DOT.

Summary of Substitute Bill:

The limitation on the number of PPI projects is removed.  A legislative oversight committee is formed to study and make recommendations on the future of the PPI program at the DOT.

Substitute Bill Compared to Original Bill:

Provisions providing for an advisory election and a local involvement committee are restored.  A legislative advisory committee is formed to study and make recommendations on the future of the PPI program at the DOT.

Appropriation:  None.

Fiscal Note:  Requested on February 26, 2002.

Effective Date of Substitute Bill:  Ninety days after adjournment of session in which bill is passed.
