Title:  An act relating to the commercial driver's license skills test.

Background:  A person may not obtain a commercial driver=s license (CDL) unless he or she has passed a knowledge and skills test for driving a commercial vehicle.  The Department of Licensing (DOL) enters into contracts with third party testers to perform the skills test portion of the test.  Typically, the third party testers are located in rural areas.  DOL has promulgated a rule that allows it to deny an application or refuse to renew a contract with a tester if it does not believe the tester will conduct a sufficient number of skills tests on an annual basis.

 

Summary of Bill:  In counties made up entirely of islands, DOL may not refuse to renew or enter into a contract with a third party tester for the skills portion of the CDL test based upon DOL=s belief that the tester will not conduct a sufficient number of tests on an annual basis.

 

Appropriation:  None.

Effective Date:  Ninety days after adjournment of session in which bill is passed.
