Crediting certain charges for irrigation pumping installations.


    AN ACT Relating to electricity rate structure for irrigation pumping installations; adding a new section to chapter 80.28 RCW; adding a new section to chapter 54.16 RCW; adding a new section to chapter 35.92 RCW; adding a new section to chapter 23.86 RCW; adding a new section to chapter 24.06 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 80.28 RCW to read as follows:

    For a period of twenty-four months beginning on April 1, 2001, any minimum or fixed amount charge, such as a load size charge or standby charge, imposed by an electric company on agricultural irrigation and soil drainage pumping installations that does not reflect the actual electricity used by the customer must be credited against charges for actual usage for the annual billing period to which the minimum or fixed charge applies.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 54.16 RCW to read as follows:

    For a period of twenty-four months beginning on April 1, 2001, any minimum or fixed amount charge, such as a load size charge or a standby charge, imposed by the district on agricultural irrigation and soil drainage pumping installations that does not reflect the actual electricity used by the customer must be credited against charges for actual usage for the annual billing period to which the minimum or fixed charge applies.

 

    NEW SECTION.  Sec. 3.  A new section is added to chapter 35.92 RCW to read as follows:

    For a period of twenty-four months beginning on April 1, 2001, any minimum or fixed amount charge, such as a load size charge or a standby charge, imposed by a municipal utility on agricultural irrigation and soil drainage pumping installations that does not reflect the actual electricity used by the customer must be credited against charges for actual usage for the annual billing period to which the minimum or fixed charge applies.

 

    NEW SECTION.  Sec. 4.  A new section is added to chapter 23.86 RCW to read as follows:

    For a period of twenty-four months beginning on April 1, 2001, any minimum or fixed amount charge, such as a load size charge or a standby charge, imposed by a locally regulated utility on agricultural irrigation and soil drainage pumping installations that does not reflect the actual electricity used by the customer must be credited against charges for actual usage for the annual billing period to which the minimum or fixed charge applies.

 

    NEW SECTION.  Sec. 5.  A new section is added to chapter 24.06 RCW to read as follows:

    For a period of twenty-four months beginning on April 1, 2001, any minimum or fixed amount charge, such as a load size charge or a standby charge, imposed by a locally regulated utility on agricultural irrigation and soil drainage pumping installations that does not reflect the actual electricity used by the customer must be credited against charges for actual usage for the annual billing period to which the minimum or fixed charge applies.

 

    NEW SECTION.  Sec. 6.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and takes effect immediately.
