Creating an office of privacy protection.


    AN ACT Relating to creating an office of privacy protection; and adding new sections to chapter 43.10 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 43.10 RCW to read as follows:

    The office of privacy protection is created within the office of the attorney general for the purpose of monitoring and ensuring compliance with statutes, rules, and policies pertaining to the right of citizens to keep nonpublic personal information private and confidential.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 43.10 RCW to read as follows:

    (1) The office of privacy protection has the following duties:

    (a) Administer a system for recording and posting policies, as may be required by law to be filed with the office, concerning the privacy of nonpublic personal information.  Such posting may include, but is not limited to, the development of an internet web site providing public access to policies and other information online;

    (b) Provide technical assistance to businesses developing policies regarding the use of personal information, including developing model information privacy policies;

    (c) Provide consumer education and be a central contact point for consumer information on privacy policies and identity theft issues; and

    (d) Assist local prosecutors to coordinate prosecution of crimes related to identity theft.

    (2) As used in this section, "nonpublic personal information" means personally identifiable information provided by a consumer to an information custodian resulting from any transaction with the consumer or any service performed for the consumer, or otherwise obtained by an information custodian; but does not include publicly available information as that term is defined by federal regulations under P.L. 106-102 (Gramm-Leach-Bliley Act of 1999).
