Making payroll deductions for individual providers as defined in RCW 74.39A.240(4).


    AN ACT Relating to making payroll deductions for individual providers as defined in RCW 74.39A.240(4); and amending RCW 41.56.110.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 41.56.110 and 1973 c 59 s 1 are each amended to read as follows:

    (1) Upon the written authorization of any public employee within the bargaining unit and after the certification or recognition of such bargaining representative, the public employer shall deduct from the pay of such public employee the monthly amount of dues as certified by the secretary of the exclusive bargaining representative and shall transmit the same to the treasurer of the exclusive bargaining representative.

    (2)(a) The state shall deduct (i) dues from the pay of individual providers, defined in RCW 74.39A.240(4) and employed by the home care quality authority for purposes of collective bargaining, after the certification or recognition of an exclusive bargaining representative of those individual providers, and (ii) other payments as provided in any agreement between the authority and the exclusive bargaining representative.

    (b)(i) An agreement under (a)(ii) of this subsection is subject to written authorization of the individual provider, except under (b)(ii) of this subsection, and reimbursement by the exclusive bargaining representative to the state for the additional costs incurred when making the deductions.

    (ii) If an agreement under (a)(ii) of this subsection contains an agency shop provision, the state shall also deduct a fee equivalent to dues from the pay of all nonmembers of the exclusive bargaining representative under RCW 41.59.100.
