_1      AN ACT Relating to the legal presumption from certification of

_2  medical records; and amending RCW 70.02.070.

     

_3  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

     

_4      Sec. 1.  RCW 70.02.070 and 1995 c 292 s 20 are each amended to read

_5  as follows:

_6      Upon the request of the person requesting the record, the

_7  health care provider or facility shall certify the record

_8  furnished and may charge for such certification in accordance with

_9  RCW 36.18.016(5).  No record need be certified until the fee is

10  paid.  The certification shall be affixed to the record and

11  disclose:

12      (1) The identity of the patient;

13      (2) The kind of health care information involved;

14      (3) The identity of the person to whom the information is being

15  furnished;

16      (4) The identity of the health care provider or facility

17  furnishing the information;

18      (5) The number of pages of the health care information;

_1      (6) The date on which the health care information is furnished;

_2  and

_3      (7) That the certification is to fulfill and meet the

_4  requirements of this section.

_5      Treatment charges on a health care provider's billing statement

_6  certified under this section for treatment provided to a patient

_7  are presumably the reasonable value of necessary health care

_8  treatment.  A certified health care provider billing statement is

_9  admissible to establish the reasonable and necessary charges.  The

10  presumption that the charges are reasonable and necessary may be

11  rebutted upon a showing of sufficient proof.
