_1      AN ACT Relating to administering emergency services to school

_2  students experiencing severe hypoglycemia; adding new sections to

_3  chapter 28A.210 RCW; and adding a new section to chapter 18.79

_4  RCW.

     

_5  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

     

_6      NEW SECTION.  Sec. 1.  A new section is added to chapter 28A.210

_7  RCW to read as follows:

_8      Public school districts and private schools may provide for the

_9  administration of glucagon to students who experience severe

10  hypoglycemia when the students are in the custody of the school

11  district or private school, pursuant to chapter 18.79 RCW, if the

12  glucagon is provided in compliance with:

13      (1) Rules adopted under section 3 of this act by the state

14  nursing care quality assurance commission, and the instructions of

15  a registered nurse or advanced registered nurse practitioner

16  issued under the rules; and

17      (2) Written policies of the school district or private school

_1  that are adopted to implement this section and are developed in

_2  accordance with chapters 41.56 and 41.59 RCW.

     

_3      NEW SECTION.  Sec. 2.  A new section is added to chapter 28A.210

_4  RCW to read as follows:

_5      (1) If a school employee provides for the administration of

_6  glucagon to a student under chapter 18.79 RCW and this chapter in

_7  substantial compliance with:  (a) Rules adopted by the state

_8  nursing care quality assurance commission and the instructions of

_9  a registered nurse or advanced registered nurse practitioner

10  issued under such rules, and (b) written policies of the school

11  district or private school, then the employee, the employee's

12  school district or school of employment, and the members of the

13  governing board and chief administrator thereof shall not be

14  liable in any criminal action or for civil damages in their

15  individual, marital, governmental, corporate, or other capacity as

16  a result of providing glucagon.

17      (2) Administering glucagon to any student under chapter 18.79

18  RCW and this chapter may be discontinued by a public school

19  district or private school, and the school district or school, its

20  employees, its chief administrator, and members of its governing

21  board shall not be liable in any criminal action or for civil

22  damages in their individual, marital, governmental, corporate, or

23  other capacity as a result of the discontinuance:  PROVIDED, That

24  the chief administrator of the public school district or private

25  school, or his or her designee, has first provided actual notice

26  orally or in writing in advance of the date of discontinuance to a

27  parent or legal guardian of the student or other person having

28  legal control over the student:  PROVIDED FURTHER, That the public

29  school district otherwise provides for the administration of

30  glucagon of the student to the extent required by federal or state

31  law.

     

32      NEW SECTION.  Sec. 3.  A new section is added to chapter 18.79

33  RCW to read as follows:

34      (1) In accordance with the rules adopted by the commission,

35  public school districts and private schools may provide for the

_1  administration of glucagon to students in severe hypoglycemia when

_2  the students are in the custody of the school district or private

_3  school.

_4      (2) After consultation with staff of the superintendent of

_5  public instruction, the commission shall adopt rules in accordance

_6  with chapter 34.05 RCW, that provide for the following and such

_7  other matters as the commission deems necessary to the proper

_8  implementation of this section:

_9      (a) A requirement for a written, current, and unexpired request

10  from a parent, legal guardian, or other person having legal

11  control over the student that the school district or private

12  school provide for the administering of glucagon to the student;

13      (b) A requirement for a written, current, and unexpired request

14  from a physician licensed under chapter 18.71 or 18.57 RCW that

15  administering glucagon to a student be provided for during the

16  hours when school is in session or the hours when the student is

17  under the supervision of school officials;

18      (c) A requirement for written, current, and unexpired

19  instructions from an advanced registered nurse practitioner or a

20  registered nurse licensed under this chapter regarding

21  administration of glucagon that include:  (i) A designation of the

22  school district or private school employee or employees who may

23  administer the glucagon, and (ii) a description of the nature and

24  extent of any required supervision; and

25      (d) The nature and extent of acceptable training that shall:

26  (i) Be provided by a physician, advanced registered nurse

27  practitioner, or registered nurse licensed under chapter 18.71 or

28  18.57 RCW, or this chapter, and (ii) be required of school

29  district or private school employees who administer the glucagon

30  to the student under this section, except that a licensed

31  practical nurse licensed under this chapter is exempt from

32  training.
