_1 AN ACT Relating to private investigator licenses; and amending
_2 RCW 18.165.030 and 18.165.080.
_3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
_4 Sec. 1. RCW 18.165.030 and 1995 c 277 s 19 are each amended to
_5 read as follows:
_6 An applicant must meet the following minimum requirements to
_7 obtain a private investigator license:
_8 (1) Be at least eighteen years of age;
_9 (2) Be a citizen or resident alien of the United States;
10 (3) Not have been convicted of a crime in any jurisdiction, if
11 the director determines that the applicant's particular crime
12 directly relates to his or her capacity to perform the duties of a
13 private investigator and the director determines that the license
14 should be withheld to protect the citizens of Washington state.
15 The director shall make her or his determination to withhold a
16 license because of previous convictions notwithstanding the
17 restoration of employment rights act, chapter 9.96A RCW;

_1 (4) Be employed by or have an employment offer from a private
_2 investigator agency or be licensed as a private investigator
_3 agency;
_4 (5) Submit a set of fingerprints;
_5 (6) Submit two color photographs;
_6 (7) Pay the required nonrefundable fee for each application;
_7 and
_8 (((7))) (8) Submit a fully completed
application that includes
_9 proper identification on a form prescribed by the director for
10 each company of employment.
11 Sec. 2. RCW 18.165.080 and 1995 c 277 s 26 are each amended to
12 read as follows:
13 (1) The director shall issue a private investigator license
14 card to each licensed private investigator and an armed private
15 investigator license card to each armed private
16 investigator. License cards must include picture identification.
17 (a) The license card may not be used as security clearance.
18 (b) A private investigator shall carry the license card
19 whenever he or she is performing the duties of a private
20 investigator and shall exhibit the card upon request.
21 (c) An armed private investigator shall carry the license card
22 whenever he or she is performing the duties of an armed private
23 investigator and shall exhibit the card upon request.
24 (2) The director shall issue a license certificate to each
25 licensed private investigator agency.
26 (a) Within seventy-two hours after receipt of the license
27 certificate, the licensee shall post and display the certificate
28 in a conspicuous place in the principal office of the licensee
29 within the state.
30 (b) It is unlawful for any person holding a license certificate
31 to knowingly and willfully post the license certificate upon
32 premises other than those described in the license certificate or
33 to materially alter a license certificate.
34 (c) Every advertisement by a licensee that solicits or
35 advertises business shall contain the name of the licensee, the
36 address of record, and the license number as they appear in the
37 records of the director.

_1 (d) The licensee shall notify the director within thirty days
_2 of any change in the licensee's officers or directors or any
_3 material change in the information furnished or required to be
_4 furnished to the director.
