Marketing farmer-produced bottled wine.


    AN ACT Relating to the agricultural marketing of farmer-produced bottled wine at farmers' markets; and adding a new section to chapter 66.12 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 66.12 RCW to read as follows:

    (1) Nothing in this title shall prevent any holder of a domestic winery license who is otherwise lawfully authorized to sell wine from selling bottled wine at a farmers' market.

    (2) In order to qualify for this exemption, the seller:

    (a) Must not produce more than five thousand cases of wine each year;

    (b) Must have grown the fruit from which the wine being sold is made;

    (c) Must have fermented, aged, and bottled the wine being sold; and

    (d) Must sell the wine only in the county where the winery is located or, if there is no farmers' market in the county where the winery is located, then in an adjacent county.

    (3) For purposes of this section, "farmers' market" means a membership of five or more growers who assemble at a defined location for the purpose of selling their produce directly to consumers.
