_1      AN ACT Relating to funds for operating and maintenance of low‑

_2  income housing projects and for innovative housing demonstration

_3  projects; amending RCW 36.18.010; adding a new section to chapter

_4  36.22 RCW; adding a new section to chapter 43.330 RCW; and

_5  creating a new section.

     

_6  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

     

_7      NEW SECTION.  Sec. 1.  The legislature recognizes housing

_8  affordability has become a significant problem for a large portion

_9  of society in many parts of Washington state in recent years.  The

10  state has traditionally focused its resources on housing for low-

11  income populations.  Additional funding resources are needed for

12  operation and maintenance activities for housing projects for the

13  developmentally disabled and farm worker housing projects.  In

14  addition to supporting low-income populations, the state must find

15  new methods to assist moderate and middle-income populations who

16  are having a difficult time affording decent housing at today's

17  prices reasonably near their jobs.

_1      NEW SECTION.  Sec. 2.  A new section is added to chapter 36.22

_2  RCW to read as follows:

_3      (1) Except as provided in subsection (2) of this section, a

_4  surcharge of three dollars per instrument shall be charged by the

_5  county auditor for each document recorded, which will be in

_6  addition to any other charge authorized by law.  The auditor may

_7  retain up to ten percent of these funds collected to administer

_8  the collection of these funds.  Of the remaining funds, forty

_9  percent of the revenue generated through this surcharge will be

10  transmitted monthly to the state treasurer who will deposit the

11  funds into the Washington housing trust account.  The office of

12  community development of the department of community, trade, and

13  economic development will develop guidelines for:  (a) The use of

14  these funds to support operation and maintenance costs of low-

15  income housing projects that have been developed with housing

16  trust funds; and (b) innovative housing demonstration projects for

17  moderate and middle-income populations.  Sixty percent of the

18  revenue generated by this surcharge will be retained by the county

19  and be deposited into a fund that must be used by the county and

20  its cities and towns for low-income housing projects.  For purposes

21  of distributing the portion of the surcharge retained by a county

22  pursuant to subsection (2) of this section, the funds shall be

23  allocated among the county and the cities within a county through

24  an interlocal agreement between the county and the cities within

25  the county to jointly carry out the purposes of this act.

26      (2) The surcharge imposed in this section does not apply to

27  assignments or substitutions of previously recorded deeds of

28  trust.

     

29      Sec. 3.  RCW 36.18.010 and 1999 c 233 s 3 are each amended to read

30  as follows:

31      County auditors or recording officers shall collect the

32  following fees for their official services:

33      For recording instruments, for the first page eight and one-

34  half by fourteen inches or less, five dollars; for each additional

35  page eight and one-half by fourteen inches or less, one dollar.

36  The fee for recording multiple transactions contained in one

37  instrument will be calculated for each transaction requiring

_1  separate indexing as required under RCW 65.04.050 as follows:  The

_2  fee for each title or transaction is the same fee as the first

_3  page of any additional recorded document; the fee for additional

_4  pages is the same fee as for any additional pages for any recorded

_5  document; the fee for the additional pages may be collected only

_6  once and may not be collected for each title or transaction;

_7      For preparing and certifying copies, for the first page eight

_8  and one-half by fourteen inches or less, three dollars; for each

_9  additional page eight and one-half by fourteen inches or less, one

10  dollar;

11      For preparing noncertified copies, for each page eight and one-

12  half by fourteen inches or less, one dollar;

13      For administering an oath or taking an affidavit, with or

14  without seal, two dollars;

15      For issuing a marriage license, eight dollars, (this fee

16  includes taking necessary affidavits, filing returns, indexing,

17  and transmittal of a record of the marriage to the state registrar

18  of vital statistics) plus an additional five-dollar fee for use

19  and support of the prevention of child abuse and neglect

20  activities to be transmitted monthly to the state treasurer and

21  deposited in the state general fund plus an additional ten-dollar

22  fee to be transmitted monthly to the state treasurer and deposited

23  in the state general fund.  The legislature intends to appropriate

24  an amount at least equal to the revenue generated by this fee for

25  the purposes of the displaced homemaker act, chapter 28B.04 RCW;

26      For searching records per hour, eight dollars;

27      For recording plats, fifty cents for each lot except cemetery

28  plats for which the charge shall be twenty-five cents per lot;

29  also one dollar for each acknowledgment, dedication, and

30  description:  PROVIDED, That there shall be a minimum fee of twenty-

31  five dollars per plat;

32      For recording of miscellaneous records not listed above, for

33  the first page eight and one-half by fourteen inches or less, five

34  dollars; for each additional page eight and one-half by fourteen

35  inches or less, one dollar;

36      For modernization and improvement of the recording and indexing

37  system, a surcharge as provided in RCW 36.22.170.

_1      For recording an emergency nonstandard document as provided in

_2  RCW 65.04.047, fifty dollars, in addition to all other applicable

_3  recording fees.

_4      For recording instruments, a surcharge as provided in section 2

_5  of this act.

     

_6      NEW SECTION.  Sec. 4.  A new section is added to chapter 43.330

_7  RCW to read as follows:

_8      The office of community development of the department of

_9  community, trade, and economic development is directed to conduct

10  a statewide housing market analysis by region.  The purpose of the

11  analysis is to identify areas of greatest need for the appropriate

12  investment of state affordable housing funds.  The analysis shall be

13  completed by September 2002, and updated every two years

14  thereafter.  Funding for this analysis is from revenue identified in

15  section 2 of this act.
