HB 1922 - DIGEST

 

     Authorizes the establishment of an independent, nonprofit organization known as the Washington climate center to serve as a central clearinghouse for all climate change activities in the state.

     Provides that the center shall be funded through:  (1) Cash and in-kind contributions; and (2) administrative fees for services as provided in this act.

     Provides that all emitters of greenhouse gases from the production of electricity and the burning of transportation fuels are required to mitigate their emissions effective January 1, 2002.

     Declares that emissions of greenhouse gases from all other sectors, including, but not limited to, agriculture, aluminum, cement, forestry, natural gas for heating, and solid waste are exempt from the provisions of this act through the year 2006.

     Provides that any person may privately enforce in the superior court any mandatory provision of this act by:  (1) Giving the alleged violator written notice of the allegation; and (2) providing the alleged violator with forty-five days to comply with the terms of this act.  If the alleged violator still does not appear to have complied with this act, any person may bring an action against the alleged violator.  The prevailing party is entitled to costs and attorneys' fees.
