Provides that, upon the decision to arrest or an arrest, and upon the request by the school, law enforcement shall release information, including incident reports, to the school pertaining to the investigation, diversion, or prosecution of a juvenile attending the school if: (1) The victim of the alleged offense is an employee or student at the school and the alleged offense occurred on school property or under school supervision; or (2) the alleged offense involves school property.
Provides that, however, if release of an incident report under this act would jeopardize the investigation or prosecution or endanger witnesses, law enforcement shall release information to the extent possible to assist schools in protecting other students, staff, and school property.
Declares that the school may use the information provided under this act only for the purposes of formulating or amending an educational plan for the student or investigating misconduct for which discipline, suspension, or expulsion action may be imposed in compliance with the school's rules and procedures.
