On page 1, after line 21 of the amendment, insert the following:

"(5) The storage and use of water from facilities or ponds described in subsection (4)(b), (4)(c), or (4)(d) of this section must not impair any water right, including but not limited to an instream flow right."

EFFECT: Prohibits the storage or use of the facilities and ponds exempted from permitting by the amendment from impairing any water right, including an instream flow right.
