On page 7, after line 16, insert the following:

"(2) If a person subject to the assessment under RCW 35.87A.010(3) believes that the benefits received by the business are disproportionate to the assessment paid, the person may petition the legislative authority to modify the rate. The person may demonstrate grievance by providing data that indicates, relative to the level of assessment paid, the increase in activity at the business is substantially dissimilar to the increase in activity to other businesses in the area. The legislative authority shall consider the petition and shall modify the rate if the person reasonably demonstrates that the benefits received are disproportionate to the assessment paid."

EFFECT: Allows hotels or other lodging businesses to petition the legislative authority governing the parking and business improvement area if it is believed that the benefits are not commensurate with the assessments. Requires the legislative authority to modify the assessment rate if the assessment payer can reasonably demonstrate that the benefits are not commensurate.
