On page 2, line 28, after "county." insert "If a minimal amount of valid science is available for a critical area, the local government with jurisdiction over the critical area may employ innovative or experimental approaches to protect the critical area if the local government documents its concerns that the minimal amount of available valid science precludes the jurisdiction from being certain of its regulatory conclusions. For the purposes of this section, the documented concerns must be in the record established by the local government."

EFFECT: (1) Deletes intent section. (2) Makes best available science a factor to be considered when designating and protecting critical areas. (3) Deletes a provision from the definition of "best available" requiring science to be practically and economically feasible to be implemented. (4) Requires development regulations adopted to comply with best available science requirements to be implemented only if they are practically and economically feasible to be implemented. (5) Allows local governments to employ innovative or experimental approaches to protecting critical areas for which minimal valid science is available if specified criteria are met. (6) Deletes a provision allowing local governments to employ innovative approaches to protect critical areas when the approaches include the best available science. (7) Deletes references to critical area functions and values in a provision requiring specific monitoring and management techniques when experimental protective approaches are employed.
