On page 1, line 17, after "section," strike all material through "section," on page 2, line 1

On page 2, line 2, after "or" insert "if the person has previously been convicted"

EFFECT: Elevates indecent exposure to a class C felony when the person has a previous conviction in this state or elsewhere of indecent exposure and the elements of the previous offense are identical to the elements in the state indecent exposure statute. Eliminates the provisions that elevate indecent exposure to a class C felony when the person has a previous conviction for any municipal lewd conduct or indecent exposure ordinance for conduct that would also constitute a violation of the state indecent exposure statute.
