On page 2, line 6, after "of the" insert "substance of any"

On page 2, line 11, after "RCW." insert "Failure to maintain a written record of the disclosure waives the immunity provided under subsection (1) of this section, and civil liability for such disclosure shall be evaluated under common law standards without regard to this act."

On page 2, line 16, after "employer's" insert "lawful"

EFFECT: Requires that an employer keep a written record only of the substance of information disclosed. Provides that failure to keep such record results in a waiver of immunity and reversion to common law standards of civil liability. Limits the definition of "job performance" to adherence to "lawful" employment policies.
