   On page 7, line 25, after "contracts;" strike "or"

   On page 7, line 26, after "(b)" insert the following:

"Contracts with low bidders that have nexus with the state. For the purposes of this subsection, the term "nexus" means business activities conducted by a person sufficient to subject that person to the taxing jurisdiction of the state under the standards established for interstate commerce under the commerce clause of the United States Constitution; or

(c)"

EFFECT: Makes the prohibition against services being performed at locations outside the United States inapplicable to contracts for which the low bidder has nexus with the state such that its business activities subject the low bidder to the state's taxing jurisdiction.
