   On page 3, after line 4 of the amendment, insert the following:

   "(5) The charge imposed under this act does not apply to a lodging business that provides written notice that it will not be subject to the charge under this act. The notice shall be sent to the legislative authority within ten days of the adoption of the ordinance in section 8 of this act."

EFFECT: Allows lodging businesses to opt out of participating in the tourism promotion charge.
