On page 3, line 6, after "action." insert "The state shall be liable whether or not the person involved in the delivery of services through the department of corrections exercised reasonable care and skill in arriving at the judgment to follow a particular course of action, if the poor outcome is a result of the actions of an individual under the supervision of the department of corrections who has ever been convicted of the crime of first, second, or third degree rape; first, second, or third degree rape of a child; first or second degree homicide; or first or second degree manslaughter."
