On page 1, line 12, strike "July 1, 2008" and insert "December 31, 2009"

On page 1, after line 18, insert the following:

"(3) A utility may at its option agree to assume the relocation costs in subsection (2) of this section."

Renumber the remaining subsections consecutively.

EFFECT: Beginning December 31, 2009, a regional transit authority (RTA) must pay for a utility's relocation costs caused by the construction of an RTA rail project; however, a utility may agree to assume the relocation costs.
