Background: Under the Uniform Parentage Act, current law permits a person to rescind an acknowledgment or denial of paternity within 60 days after the effective day of the filing of the document. There is concern that this provision needs clarification.

 

Summary of Bill: A person who wishes to rescind his acknowledgment or denial of paternity must do so within 60 days after the effective date of the document.

 

Appropriation: None.

 

Fiscal Note: Not requested.

 

Effective Date: Ninety days after adjournment of session in which bill is passed.

 

Testimony For: Currently, the effective date is the date that the document is received by the Department of Health and "of the filing" has no meaning. This technical amendment would prevent future problems if the two dates were to differ.
