SSB 5751

As Passed Senate, March 17, 2003

Title: An act relating to sales of valuable materials.

Brief Description: Concerning the sale of valuable material from state lands.

Sponsors: Senate Committee on Natural Resources, Energy & Water (originally sponsored by Senator Hargrove).

Brief History:

Committee Activity: Natural Resources, Energy & Water: 2/20/03, 2/28/03 [DPS].

Passed Senate: 3/17/03, 48-0.

SENATE COMMITTEE ON NATURAL RESOURCES, ENERGY & WATER

Majority Report: That Substitute Senate Bill No. 5751 be substituted therefor, and the substitute bill do pass.

Signed by Senators Morton, Chair; Doumit, Fraser, Hale, Hargrove, Honeyford and Regala.

Staff: Victor Moon (786-7469)

Background: The state Department of Natural Resources sells valuable materials from state lands. They are sold as a lump sum sale or as a scale sale. The amount that the department can sell is limited by statute. The unit size for public land timber harvest units is established by the Board of Natural Resources, but the board does not have authority to set the value amount of the sales.

Summary of Bill: The amount of valuable materials that can be sold at a direct sale is set by the Board of Natural Resources after appraisal.

Appropriation: None.

Fiscal Note: Not requested on substitute.

Effective Date: Ninety days after adjournment of session in which bill is passed.

Testimony For: The department understands the intent of the proposal and will work with the sponsor to develop a bill.

Testimony Against: None.

Testified: Doug Sutherland, Commissioner of Public Lands; Howard Thronson, Dept. of Natural Resources.

House Amendment(s): Rather than allowing the Board of Natural Resources to set an unlimited value for direct valuable material sales, the existing statutory cap on the dollar value of a direct sale is increased from $20,000 to $25,000.
