Background: There are two sections in the RCWs authorizing the creation of public facilities districts (PFDs). Under 35.57 RCW cities and towns can create PFDs alone, or enter into an interlocal agreement to create a PFD with contiguous towns or cities and their respective counties. This bill does not amend city PFD statutes.
Counties, on the other hand, can create a countywide PFD under 36.100 RCW. A PFD created under this section is coextensive with the boundaries of the county and is governed by a board of directors consisting of five or seven members, depending on the population of the county and the largest city within the county. Members of the board are appointed by the county legislative authority, the city council of the largest city in the county, other members of the board, and in some cases by the Governor and the county executive. Members of the board serve four-year terms and vacancies on the board are filled by appointment for the remainder of the unexpired term of office. However, there are no provisions dealing with temporary appointments when a board member must take a leave of absence.
Summary of Bill: The appointing authority of the board of directors for a countywide PFD may approve a leave of absence for any board member and temporarily fill the position for the term of the approved leave of absence. The term of office is not extended by the approved leave.
