Background: With limited exceptions, municipal officers are prohibited from benefitting, directly or indirectly, in any contract made by the officer. One such exception allows a municipal officer to benefit from a municipal contract when the city has a population of less than 10,000 and the total amount received under the contract does not exceed $1,500 in any month; or the contract may exceed $1,500 in any month but cannot exceed $18,000 in any calendar year.

 

A municipal officer is defined as all elected and appointed officers of a municipality, together with all deputies and assistants.

 

Summary of Bill: The population threshold for a city above which a municipal officer cannot benefit from a municipal contract is changed from 10,000 to 40,000.

 

Appropriation: None.

 

Fiscal Note: Not requested.

 

Effective Date: Ninety days after adjournment of session in which bill is passed.
