AN ACT Relating to the tribal law enforcement officers act of 2003; creating a new section; and providing an expiration date.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 (1) A joint select committee on tribal law
enforcement relations is established.
(2) The joint select committee shall consist of thirty-nine members
to be appointed as follows:
(a) One member from each of the two largest caucuses of the house
of representatives, appointed by the speaker of the house of
representatives;
(b) One member from each of the two largest caucuses of the senate,
appointed by the president of the senate;
(c) One member from each of the twenty-nine federally recognized
tribes in Washington. Each tribe shall appoint its own individual
member;
(d) One member with expertise in tribal law enforcement, appointed
by the Washington association of tribal enforcement officers;
(e) One member who is a prosecuting attorney, appointed by the
Washington association of prosecuting attorneys;
(f) One member who is an attorney whose practice includes a
significant amount of time devoted to criminal defense, appointed by
the Washington state bar association;
(g) One member who is an elected sheriff or police chief, appointed
by the Washington association of sheriffs and police chiefs;
(h) One member with expertise in relations between the state and
the tribes, appointed by the governor; and
(i) One member who is a nontribal person occupying land held in fee
simple within the boundaries of tribal land, appointed by the governor.
(3) The joint select committee shall study and make recommendations
to the legislature and the governor regarding:
(a) The jurisdiction of tribal, state, and local law enforcement
officers over tribal and nontribal persons on tribal lands; and
(b) The extension of general authority peace officer powers to
tribal law enforcement officers and the effect that the extension would
have on tribal and nontribal persons, including nontribal persons
occupying land held in fee simple within the boundaries of tribal
lands.
(4) The joint select committee shall present a report of its
findings and recommendations, including any proposed legislation, to
the governor and the appropriate standing committees of the legislature
no later than December 1, 2003.
(5) Staff support shall be provided to the joint select committee
by the office of program research and senate committee services.
(6) This section expires March 31, 2004.
