     AN ACT Relating to penalties for trading in nonambulatory livestock; adding a new section to chapter 16.36 RCW; prescribing penalties; and declaring an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1   A new section is added to chapter 16.36 RCW to read as follows:
     (1) Any person who knowingly transports or accepts delivery of nonambulatory livestock is subject to a fine of up to one thousand dollars per day. The transport or acceptance of each nonambulatory livestock animal is considered a separate and distinct violation. The fine authorized in this section is in addition to any criminal violation specified in RCW 16.36.110 and any other penalty provided by law.
     (2) The department shall set the amount of the fine authorized in this section after considering the:
     (a) History of the violator;
     (b) Severity of the violation's impact on the health and safety of the public and the state's animal population; and
     (c) Significance of the risk created for the health and safety of the public and the state's animal population.
     (3) This section does not apply to the:
     (a) Transport or acceptance by a veterinarian licensed under chapter 18.92 RCW of nonambulatory livestock under his or her care, including the delivery or acceptance by a veterinarian licensed under chapter 18.92 RCW of nonambulatory livestock to provide appropriate medical care and treatment or euthanasia of a nonambulatory livestock animal; and
     (b) Transport of nonambulatory livestock for the appropriate care, medical treatment, or euthanasia on a farm.

NEW SECTION.  Sec. 2   This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and takes effect immediately.
