Establishing standards for the expeditious payment of bills incurred by state government.

       Finds that: (1) Firms and organizations that do business with the state expect and deserve to be paid in an expeditious and timely manner; and

       (2) Unjustified delays in paying vendors, construction contractors, and providers of service may discourage these firms and organizations, in particular small and medium-sized firms and women and minority-owned business enterprises, from doing business with the state, and may ultimately increase the costs to the state government.

       Declares it is the purpose of this act to set standards for the payment of bills incurred by state agencies within specified periods of time and to require interest payments in situations where contract payments do not conform to these standards.

Authorizing the use of signs, banners, or decorations over highways under limited circumstances.

       Declares that the uniform system adopted by the secretary under this act may allow signs, banners, or decorations over a highway that: (1) Are in unincorporated areas;

       (2) Are at least twenty vertical feet above a highway; and

       (3) Do not interfere with or obstruct the view of any traffic control device.

       Requires the department to adopt rules regulating signs, banners, or decorations installed under this act.

Establishing apprenticeship utilization requirements for public works projects.

       Provides that, from July 1, 2003, through December 31, 2003, for all public works estimated to cost two million dollars or more, all specifications shall require that no less than ten percent of the labor hours within each trade be performed by apprentices of that trade.

        Provides that, from January 1, 2004, through December 31, 2004, for all public works estimated to cost two million dollars or more, all specifications shall require that no less than twelve percent of the labor hours within each trade be performed by apprentices of that trade.

        Provides that, from January 1, 2005, and thereafter, for all public works estimated to cost one million dollars or more, all specifications shall require that no less than fifteen percent of the labor hours within each trade be performed by apprentices of that trade.

Enacting the health facility quality assurance and patient protection act.

        Finds and declares that it is in the interest of the public health and safety to assure access to quality facility-based health care services that minimizes risks to patient safety.

        Declares that quality assurance includes the ability of the state to redress risks to patient safety effectively and efficiently with a rapid remediation system that operates in tandem with a broad range of remedies for correcting defective hospital health care services.

        Finds that the availability of a cooperative rapid remediation system in lieu of sanctions offers a prudent opportunity to address health and safety problems that minimizes risks to patient safety and avoids the delays and inconveniences of the formal sanctioning process.

        Provides that this act applies only to those facilities or services specified.

        Does not apply to a facility or service not specifically cited.

        Declares that the facilities or services covered by this act are: (1) Acute care hospitals licensed under chapter 70.41 RCW;

        (2) Psychiatric hospitals licensed under chapter 71.12 RCW; and

        (3) Alcohol and chemical dependency hospitals licensed under chapter 71.12 RCW.

        Provides that, whenever the driver of a vehicle is arrested for a violation of RCW 46.20.342, the vehicle may be impounded for reasonable cause. However, before the vehicle is subject to impoundment, a police officer shall attempt in a reasonable and timely manner to contact the owner of the vehicle and may release the vehicle to the owner if the owner is reasonably available, the owner was not in the vehicle at the time of the stop and arrest, and the owner has not received a prior release under this act.

        Provides that a sales and use tax may be fixed and imposed in accordance with the terms of chapter 82.14 RCW if: (1) A county legislative authority submits an authorizing proposition to the county voters, and the proposition is approved by a majority of persons voting on the proposition; or

       (2) A petition proposing the imposition of a sales and use tax is filed with the county auditor, the petition is signed by a number of voters equal to at least ten percent of the number of voters in the county voting at the last preceding general election, and, after meeting these requirements, an authorizing proposition is submitted to the county voters and approved by a majority of persons voting on the proposition.

Providing funds to deter, investigate, and prosecute real estate fraud crimes.

       Provides that a surcharge of two dollars shall be charged by the county auditor at the time of recording of each residential first mortgage deed of trust, which will be in addition to any other charge authorized by law. The auditor may retain up to five percent of the funds collected to administer collection.

       Requires the remaining funds to be transmitted monthly to the state treasurer who will deposit the funds into the mortgage lending fraud prosecution account created in this act.

       Provides that expenditures from the account may be used only for deterring, investigating, and prosecuting mortgage lending fraud crimes.

        Provides that the director shall transfer all deposits into the account that exceed seven hundred thousand dollars during any fiscal year to the Washington housing trust fund.

Creating a housing allowance program for nonsupervisory educational employees.

        Recognizes that, as the disparity in the cost-of-living between school districts across the state has grown in recent years, the purchasing power of equalized salaries has become more disparate for K-12 employees. A major contributor to these costs is housing.

        Declares that the purpose of this act is to authorize a housing allowance for nonsupervisory public school employees in order to encourage these employees to live in the districts in which they work.

        Authorizes eligible school districts to provide a housing allowance for nonsupervisory classified and certificated employees with revenues raised from a housing allowance levy authorized under this act.

A waiver of existing privilege or claim of confidentiality may not occur as a result of a disclosure to the commissioner under this act.

       Declares that an endorsement or certification by the county treasurer and the display of a decal is not required when a mobile home or park model trailer is being moved by a landlord as defined in RCW 59.20.030 after: (1) The mobile home or park model trailer has been abandoned as defined in RCW 59.20.030; or (2) a final judgment for restitution of the premises under RCW 59.18.410 has been executed in favor of the landlord with regard to the mobile home or park model trailer.

       Declares that in no case shall a secure community transition facility be sited: (1) In an area that has been zoned for residential or commercial uses; or

       (2) Adjacent to, immediately across a street or parking lot from, or within the line of sight of a risk potential activity or facility in existence at the time a site is listed for consideration. "Within the line of sight" means that it is possible to reasonably visually distinguish and recognize individuals.

Authorizing removal of vehicles from restricted parking zones.

       Authorizes removal when a vehicle is illegally occupying a truck, commercial loading zone, restricted parking zone, bus, loading, hooded-meter, taxi, street construction or maintenance, or other similar zone where, by order of the director of transportation or chiefs of police or fire or their designees, parking is limited to designated classes of vehicles or is prohibited during certain hours, on designated days or at all times, and where the vehicle is interfering with the proper and intended use of the zone.

In the time since the law's 1999 enactment, it has become clear that the road maintenance and abandonment plan requirement may cause an unforseen and unintended disproportionate financial hardship on small forest landowners.

       Finds that the commissioner of public lands and the governor have explored solutions that minimize the hardship caused to small forest landowners by the forest road maintenance and abandonment requirements of the forests and fish law, while maintaining protection for public resources.

       Declares that this act represents the bulk of the recommendations stemming from that process.

       Recognizes that water rights are a type of property right in which many different parties may assert an interest. Current statutes require many property rights actions in which different parties assert interests, such as actions for partition or eminent domain, to be filed in superior court.

       Finds that informal procedures such as mediation and fact-finding have been employed successfully in other areas of the law, and may produce positive results in certain types of water disputes.

       Finds that property owners should have a choice to select informal or formal hearings before the pollution control hearings board, and that relinquishment proceedings should be appealed to the court of appeals.

These changes are necessary due to the increased risks of spills, the length of time that has passed since the current standards were put in place, the recent changes that have occurred in federal statutory and case law, the comparative standards of other western states, and the recent experiences of other states with spills.

        Declares an intent that, whenever possible, the standards set for Washington state provide the highest level of protection consistent with other western states and to ultimately achieve a more uniform system of financial responsibility on the Pacific Coast.

       Declares that the people of this state have a right to a reasonable expectation of privacy on their private property.

       Finds, however, that over time statutory authority for entry onto private property has expanded to the point where the people no longer feel secure from the unreasonable intrusion of government officials and others who have been granted special immunity from prosecution for trespass.

       Declares an intent, with certain limited and necessary exceptions, that all persons, whether government employees or private persons, be made subject to the same restrictions with regard to entering upon the property of another. It is the intent to eliminate special immunities from prosecution for trespass, whether those immunities have been legislatively granted to government or to private persons or entities.

       Declares it is not the intent to change the elements of the crime of trespass, but only to make all persons subject to the same law with exceptions from uniform application of that law only for the kinds of entries onto property by law enforcement officers that are lawful as of the effective date of this act and those entries onto property by government personnel that are specified in this act.

Regulating the sale, distribution, and installation of air bags.

       Declares that a person is guilty of a gross misdemeanor if he or she knew or reasonably should have known that an air bag he or she installs or reinstalls in a vehicle for compensation, or distributes as an auto part, is a previously deployed air bag that is part of an inflatable restraint system.

       Provides that a person found guilty under this act will be punished by a fine of five thousand dollars or by confinement in the county jail for one year, or both.

       Provides that, whenever an air bag that is part of a previously deployed inflatable restraint system is replaced by either a new air bag that is part of an inflatable restraint system or a nondeployed salvage air bag that is part of an inflatable restraint system, the air bag must conform to the original equipment manufacturer requirements and the installer must verify that the self-diagnostic system for the inflatable restraint system indicates that the entire inflatable restraint system is operating properly.

Providing funds to deter, investigate, and prosecute real estate fraud crimes.

        Provides that a surcharge of two dollars shall be charged by the county auditor at the time of recording of each residential first mortgage deed of trust, which will be in addition to any other charge authorized by law. The auditor may retain up to five percent of the funds collected to administer collection.

        Requires the remaining funds to be transmitted monthly to the state treasurer who will deposit the funds into the mortgage lending fraud prosecution account created in this act.

        Provides that expenditures from the account may be used only for deterring, investigating, and prosecuting mortgage lending fraud crimes.

        Provides that the director shall transfer all deposits into the account that exceed seven hundred thousand dollars during any fiscal year to the Washington housing trust fund.

        Declares that a person is guilty of the crime of failing to summon assistance if: (1) He or she knows that another person has suffered substantial bodily harm and is in need of assistance;

        (2) He or she could reasonably summon assistance for the person in need without danger to himself or herself and without interference with an important duty owed to a third party;

        (3) He or she fails to summon assistance for the person in need; and

        (4) Another person is not summoning assistance for the person in need.

        Provides that the duty to summon assistance is satisfied by making reasonable efforts to summon emergency police, fire, or medical assistance that identifies the location of the victim.

        Declares that, except as provided in RCW 9A.76.050, failing to summon assistance is a misdemeanor.

        Repeals RCW 9A.76.060.

Reducing the release of mercury into the environment.

       Requires that, no later than one year after the effective date of this act, every manufacturer listed under the act must develop a plan for ensuring that their products that contain mercury are properly collected, transported, and recycled. The plan must: (1) Identify either an existing or new collection system through which the used products can be returned for recycling or disposed of as hazardous waste; and

       (2) Identify a funding mechanism through which the manufacturer will fund the collection system.

       Provides that, effective January 1, 2004, no person may sell, offer for sale, or distribute for sale or use in this state a mercury-added novelty. A manufacturer of mercury-added novelties must notify all retailers that sell the product about the provisions of this act and how to properly dispose of any remaining mercury-added novelty inventory.

       Provides that, effective January 1, 2004, no person may sell, offer for sale, or distribute for sale or use in this state a thermometer that contains mercury.

       Provides that, effective January 1, 2006, no person may sell, install, or reinstall a commercial or residential thermostat that contains mercury.

       Declares that no person may sell, offer for sale, or distribute for sale or use in this state a motor vehicle manufactured after January 1, 2006, if the motor vehicle contains an automotive mercury switch.

       Provides that effective January 1, 2004, a health care facility may not purchase mercury manometers.

       Requires the department of general administration to, by January 1, 2004, revise its rules, policies, and guidelines to implement the purpose of this act.

        Declares that a violation of this act or any rule adopted under this act is punishable by a civil penalty not to exceed one thousand dollars for each violation in the case of a first violation. Repeat violators are liable for a civil penalty not to exceed five thousand dollars for each repeat violation. Penalties collected under this section must be deposited in the state toxics control account created in RCW 70.105D.070.

Creating the evergreen recreation pass.

        Declares an intent that state recreation facilities be kept open and that there be a single basic pass available to the citizens of the state of Washington that would provide, for a single fee, access to the parking, day-use, trailhead and trail, and primitive overnight camping facilities owned and operated by the commission, the fish and wildlife commission, and the department of natural resources, with a single deluxe pass that would provide boat launch access in addition to the access provided in the basic pass. It is further the intent of the legislature that a similar nonresident pass be made available, at a higher cost, to visitors to the state of Washington.

        Encourages coordination with federal natural resource recreational land managers and neighboring states to develop a regional outdoor recreation pass.

        Appropriates the sum of four hundred fifty thousand dollars for the fiscal year ending June 30, 2003, from the general fund to the state parks and recreation commission for the purposes of this act. Of that sum, no more than fifty thousand dollars may be spent developing the corps of discovery pass, and the remainder must be spent solely for the reopening, operating, and maintaining of Chief Timothy, Central Ferry, Lyons Ferry, and Crow Butte state parks in anticipation of sufficient revenues from the corps of discovery pass being generated during the 2003-2005 biennium for the maintenance and operation of these state parks.
