Revising business and occupation taxation for certain aviation businesses.

       Provides that, upon every person engaging within this state in the business of making sales at retail that are exempt from the tax imposed under chapter 82.08 RCW by reason of RCW 82.08.0261, 82.08.0262, or 82.08.0263, that are classified by the federal aviation administration as FAR part 145 certificated repair stations with an airframe class 4 rating and limited capabilities in instruments, radio equipment, and specialized services, as to such persons, the amount of tax with respect to such business shall be equal to the gross proceeds of sales of the business, multiplied by the rate of .275 percent.

       Finds that the trust program can be used to facilitate the reallocation of water from one beneficial use to another.

Providing for identification of public assistance recipients with outstanding warrants.

       Provides that, on a quarterly basis, the department shall coordinate with the state patrol to determine if any recipients of public assistance have outstanding warrants from any court of competent jurisdiction for a felony or misdemeanor. The department shall immediately provide the name and address of any person found to have an outstanding warrant for his or her arrest to the state patrol. The department shall suspend payments pursuant to RCW 74.08.290 for any period a recipient is imprisoned.

Prohibiting strikes by educational employees.

       Declares it is unlawful for an employee or an employee organization, directly or indirectly, to induce, instigate, encourage, authorize, ratify, or participate in a strike.

       Declares it is unlawful for an employer to authorize, consent to, or condone a strike, to conduct a lockout, to pay or agree to pay an employee for any day in which the employee participates in a strike, or to pay or agree to pay any increase in compensation or benefits to an employee in response to or as a result of a strike or any act that violates this act.

        Provides that, if a violation of this act occurs, or is imminently threatened, any citizen domiciled within the jurisdictional boundaries of the state may petition the superior court of the county in which the school district, or any part thereof, is situated for an injunction restraining the violation or imminently threatened violation.

        Includes any person who has completed the full senior year of high school and obtained a high school diploma, both at a Washington public high school or private high school approved under chapter 28A.195 RCW, or a person who has received the equivalent of a diploma; who has lived in Washington for at least three years; who is initially admitted to an institution of higher education within one year of receiving the diploma or its equivalent; and who provides to the institution an affidavit indicating a willingness to file an application to become a permanent resident at the earliest opportunity the individual is eligible to do so.

Creating H.O.G. motorcycle plates.

        Declares that "H.O.G." motorcycle license plate means a license plate that displays a symbol of the sponsor of the Harley Owner's Group.

       Directs the department to create, design, and issue a special H.O.G. license plate that may be used in lieu of regular or personalized license plates for motorcycles, upon terms and conditions established by the department. The special license plates will commemorate the Harley Owner's Group and their goal of increasing the number of riders of all skill levels who are able to attend motorcycle safety education programs in Washington.

The director shall not adopt any new or amended rules dealing with musculoskeletal disorders that are substantially the same as these rules until and unless required by congress or the federal occupational safety and health administration.

Creating the license suspension review committee.

       Finds that existing law as it relates to the suspension of commercial fishing licenses does not take into account the real-life circumstances faced by the state's commercial fishing fleets. The nature of the commercial fishing industry, together with the complexity of fisheries regulations, is such that honest mistakes can be made by well-meaning and otherwise law-abiding fishers. Commercial fishing violations that occur within an acceptable margin of error should not result in the suspension of fishing privileges. Likewise, fishers facing the possibility of license suspension or revocation deserve the opportunity to explain any extenuating circumstances prior to having his or her professional privileges suspended.

        Declares an intent, by creating the license suspension review committee, to provide a fisher with the opportunity to explain any extenuating circumstances that led to a commercial fishing violation.

        Finds that gross abuses of fish stocks should not be tolerated. Individuals convicted of even one violation that is egregious in nature, causing serious detriment to a fishery or the competitive disposition of other fishers, should have his or her license suspended and revoked.

        Provides that a person of disability, age sixty-five or older, may take the daily limit of oysters off the beach without shucking the oysters.

Regulating vehicular pursuit.

        Requires that, by December 1, 2003, the Washington state criminal justice training commission, the Washington state patrol, the Washington association of sheriffs and police chiefs, and organizations representing state and local law enforcement officers shall develop a written model policy on vehicular pursuits.

        Requires that, by June 1, 2004, every state, county, and municipal law enforcement agency shall adopt and implement a written vehicular pursuit policy. The policy adopted may, but need not, be the model policy developed under this act. However, any policy adopted must address the minimum requirements specified.

        Requires that, by June 30, 2006, every full-time law enforcement officer employed by a state, county, or municipal law enforcement agency shall have been trained on vehicular pursuits. Every new full-time law enforcement officer employed by a state, county, or municipal law enforcement agency after June 30, 2006, also shall be trained, within six months of employment, on vehicular pursuits.
