       (2) Within twenty-five hundred feet of a public or private campground or youth camp.

       Declares that "within the line of sight" means that it is possible to reasonably visually distinguish and recognize individuals.

       Does not apply to the secure community transition facility established pursuant to RCW 71.09.250(1).

        Provides that a county or incorporated city or town may create a school or playground speed zone on a highway bordering a marked school or playground, in which zone it is unlawful for a person to operate a vehicle at a speed in excess of twenty miles per hour. The school or playground speed zone may extend three hundred feet from the border of the school or playground property.

Establishing an arthritis pilot project.

       Declares that the purposes of this act are: (1) To create and foster a statewide pilot project that promotes public awareness and increases knowledge about the causes of arthritis, the importance of early diagnosis and appropriate management, effective prevention strategies, and pain prevention and management;

       (2) To develop knowledge and enhance understanding of arthritis by disseminating underutilized but available educational materials and resources, information on research results, programs and services provided, and strategies for prevention and control to patients, health professionals, and the public;

       (3) To implement and coordinate state and local pilot projects and services to reduce the public health burden of arthritis; and

       (4) To provide lasting improvements in the delivery of health care for individuals with arthritis and their families, thus improving their quality of life while also containing health care costs.

Creating the state financial aid account.

       Declares that the primary purpose of the account is to ensure that all appropriations designated for financial aid through statewide student financial aid programs are made available to eligible students. The account shall be a nontreasury account retaining its interest earnings in accordance with RCW 43.79A.040.

       Directs the higher education coordinating board to deposit in the account all money received for the state need grant program established under RCW 28B.10.800, the state work-study program established under chapter 28B.12 RCW, the Washington scholars program established under RCW 28A.600.110, the Washington award for vocational excellence program established under RCW 28C.04.525, and the educational opportunity grant program established under chapter 28B.101 RCW.

        Declares that this act is null and void if any of the moneys from any source that have been deposited in the agricultural local fund are transferred to the general fund or authorized to be transferred to the general fund by legislation enacted after January 1, 2003, and before July 1, 2003.

        Declares that an insurer may not take an underwriting action on a policy described in this act because an insured has made one or more insurance claims during the preceding sixty months for a loss that is the result of malicious harassment. An insurer may take an underwriting action due to other factors that are not prohibited by this act.

        Declares that a violation of this act is an unfair practice under RCW 49.60.030.

Providing for reimbursement of public entities for payments made because of criminal acts of officers, employees, or contractors.

       Finds that citizens, through their government, are frequently unable to collect reimbursement from employees, officers, and contractors whose criminal conduct results in payment of public money to injured parties.

       Finds that this inability is a drain on public resources and facilitates the avoidance of responsibility by those who engage in criminal conduct. The purpose of this act is to enable public entities on behalf of the citizens to obtain reimbursement from such employees, officers, and contractors.

Reducing the number of employees in Washington management service.

       Provides that no agency may employ personnel who are classified as managers with supervisory job titles but who have no direct subordinates.

       Provides that unless prohibited by federal law, each agency shall have no more than one manager with a supervisory job title for each twenty-five nonmanagement employees within the agency.

       Requires each agency to reduce the number of employees in the Washington management service by twenty-five percent no later than December 31, 2003.

       Declares that this act shall not apply if the governor certifies to the legislature that substantive and compelling reasons exist that an agency should be exempt from complying with the provisions of this act. The governor shall submit findings and conclusions to support the certification based on empirical facts that show by clear and convincing evidence that the public will be harmed if the agency were to comply with the provisions of this act.

Supporting regional infrastructure security.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Finds that the Pacific Northwest Economic Region has launched the first multistate, binational Partnership for Regional Infrastructure Security, bringing over one hundred twenty public and private stakeholders to address interdependency issues and work toward an action plan for a "disaster resistant" region.

        Finds that the Pacific Northwest Economic Region completed the first binational critical infrastructure desktop exercise called Blue Cascades.

        Finds that the Blue Cascade exercise identified numerous areas of concern in critical infrastructure cascading effects.

        Indicates support for the United States Department of Homeland Security to develop an action plan addressing the key findings of the Blue Cascades for regional infrastructure security.

       Declares an intent to allow the use of safe and effective traps for the protection of life and property. It is also the intent to authorize the fish and wildlife commission to limit the use of inhumane traps when effective alternatives exist.

        Provides that a person may use body-gripping traps to abate an animal problem if nonlethal control tools, such as guard animals, electric fencing, or box or cage traps are not effective in abating the animal problem.

        Requires the commission to adopt rules to ensure body-gripping traps are used in a safe and humane manner. The rules may include trapping hours, seasons, area closures, trap checking frequency, and trap size and placement restrictions. The commission may prohibit the use of certain traps found to be inhumane when effective alternative traps are found to be widely available.

The earnings on the account shall be accounted for separately from other investments made by the board.

        Directs the state investment board to report annually to the legislative fiscal and economic development committees on the implementation of this act and its impact on economic development in this state.

       Finds that it is vital to support programs that enhance watchable wildlife activities and tourism, while also protecting the wildlife resources that attract the viewers. A revenue source must be created and directed to the watchable wildlife programs of the department of fish and wildlife to develop watchable wildlife opportunities in cooperation with other local, state, and federal agencies, and nongovernmental organizations.

       Authorizes the department to sell watchable wildlife decals. Proceeds from the sale of the decal must be deposited into the state wildlife fund created in RCW 77.12.170 and must be dedicated to the support of the department's watchable wildlife activities. The department may also use proceeds from the sale of the decal for marketing the decal and for marketing watchable wildlife activities in the state.

If the person lacks a fixed residence, he or she shall report to the department of corrections every twenty-four hours. To the extent that electronic monitoring devices that employ global positioning system technology are available, such devices shall be utilized.

        Requires the offender to pay the cost of electronic home monitoring or the use of alternate monitoring devices.
