       Provides that a fire protection district may protect the district's tax levy from prorationing under RCW 84.52.010(2) by imposing up to a total of twenty-five cents per thousand dollars of assessed value of the tax levies authorized under RCW 52.16.140 and 52.16.160 outside of the five dollar and ninety cent per thousand dollar of assessed valuation limitation established under RCW 84.52.043(2), if those taxes otherwise would be prorated under RCW 84.52.010(2)(e).

        Requires the commission to authorize at least two doe permits per hunter for special hunts held in damage areas when qualified department staff have confirmed six incidents of crop damage caused by deer or elk.

        Provides that, when the department receives six complaints concerning damage to commercial agricultural and horticultural crop production by wildlife from the owner or tenant of real property, or from several owners or tenants in a locale, the commission shall conduct a special hunt or special hunts to reduce the potential for the damage. Each complaint must be confirmed by a qualified department staff. The commission shall authorize at least two doe permits per hunter for special hunts held in damage areas.

        Requires the seller or lessor of any decontaminated property that is not real property to give a copy of the release for reuse document to the purchaser or lessee of the property. If a seller or lessor fails to disclose the fact that a property was formerly contaminated, the purchaser or lessee has the right of rescission and may recover under chapter 19.86 RCW.

Suspending accrual of interest for financial obligations during total confinement.

        Provides that, with respect to financial obligations imposed for offenses committed on or after July 1, 2003, interest shall not accrue during any period of time the offender is in total confinement in a correctional or state correctional institution as defined in RCW 9.94.049, an out-of-state correctional institution, or a federal correctional institution.

Providing for a sliding-scale fee for processing and issuing hydraulic project approvals applications.

       Authorizes the department to charge a fee for processing and issuing decisions on hydraulic project approvals applications. The fee must be based on the scale and complexity of the project.

       Provides that, by July 31, 2004, the commission, in collaboration with interested and affected parties, must adopt rules that set forth the fee criteria and amount for these various categories of approvals. The criteria and amounts must be based on a workload analysis conducted by the department as part of the rule development process. The fee criteria may include the capital cost of the project.

Concerning park rangers employed by the parks and recreation commission.

       Declares that park rangers vested with police powers by the commission shall enforce Title 79A RCW, rules of the commission, and other statutes as prescribed by the legislature. When prescribed by the commission, park rangers shall have and exercise, throughout the state, such police powers and duties as are vested in sheriffs and peace officers generally.

       Provides that all park rangers hired after the effective date of this act are law enforcement personnel as defined in RCW 43.101.010(4). Such park rangers must successfully complete the basic law enforcement academy course, known as the basic course, sponsored by the criminal justice training commission, or the basic law enforcement equivalency certification, known as the equivalency course, provided by the criminal justice training commission.

       Declares that nothing in this act or RCW 10.93.020 confers membership to such officers in the Washington law enforcement officers' and fire fighters' retirement system under chapter 41.26 RCW.

       Acknowledges the efforts of the national fire protection association to develop standard 1710 for the organization and deployment of substantially career fire departments, and standard 1720 as the standard for substantially volunteer fire departments.

        Declares that this act contains minimum requirements, comparable to those standards, relating to the organization and deployment of fire suppression operations, emergency medical operations, and special operations to the public.

        Finds that as the state officer with the responsibility of certifying measures to the ballot, the secretary of state should provide a formal opportunity for the general public to hear information about the impact of a ballot measure in a public setting with an opportunity for both proponents and opponents of a measure to present their arguments.

       Intends for the secretary to be a facilitator in this process and as such should maintain a neutral or nonbiased course of action throughout the public hearing process.

Concerning the annual consumptive quantity of a water right.

        Declares that the annual consumptive quantity of a water right may not be deemed to be less than the actual peak historic use of a water right, even if the right is not being fully exercised at the time of change or transfer, if: (1) The reduced use is due to cropping patterns or system efficiencies; (2) the water right holder intends to fully exercise the right; and (3) the water right holder has the ability to make beneficial use of the full right.

       Recognizes that in many cases the value of real property directly depends upon the amount of water that is available for use on that property.

       Recognizes that water rights are a type of property right in which many different parties may assert an interest. Current statutes require many property rights actions in which different parties assert interests, such as actions for partition or eminent domain, to be filed in superior court.

       Finds that informal procedures such as mediation and fact-finding have been employed successfully in other areas of the law, and may produce positive results in certain types of water disputes.

       Finds that property owners should have a choice to select informal or formal hearings before the pollution control hearings board, and that relinquishment proceedings should be appealed to the court of appeals.

        Declares and reaffirms that a core principle embodied in chapter 90.82 RCW is that state agencies must work cooperatively with local citizens in a process of planning for future uses of water by giving local citizens and the governments closest to them the utmost opportunity in determining the future allocation and management of water in the WRIA or WRIAs being planned.

        Finds that this process of local planning must have all the tools necessary to accomplish this task and that it is essential for the legislature to provide a clear statutory process for implementation so that the locally developed plan will be the adopted and implemented plan to the greatest extent possible.

        Provides that, for a public water system, the maximum number of service connections, or maximum population to be served, or size or location of the place of use, as described or specified on a water right application, permit, certificate, or claim or as described or specified in related supporting documents may not be an attribute limiting exercise of the water right if an annual quantity limit can be determined from the permit, certificate, or claim.

        Provides, however, if a water system plan is required to be approved for the public water system under chapter 43.20 RCW or as part of a coordinated water system plan under chapter 70.116 RCW, the number of service connections or population served under the water right may be further expanded only during such time as the public water system is in compliance with the requirements of its approved water system plan.

Creating the Washington water commission.

        Finds that there is a critical need to establish a single purpose agency to administer Washington's water resource laws and that the agency be directly accountable to the voters of the state of Washington.

        Declares that the findings of the governor's Washington competitiveness council released December 11, 2001, are accurate and that a water commission is necessary for the effective management of the water resources of the state.

        Declares that all powers, duties, and functions of the department of ecology pertaining to those powers and duties set out in this act are transferred to the commission. All references to the director or the department of ecology in the Revised Code of Washington shall be construed to mean the commission when referring to the functions transferred in this act.

Concerning energy efficiency and renewable energy standards.

       Finds that: (1) The western energy crisis of 2000-2001 demonstrated the vulnerability of an energy system heavily reliant on hydropower resources and impacted by volatile gas prices;

       (2) Washington electric ratepayers will benefit from resource planning and acquisition that hedges against future fuel price risk by ensuring that utilities rely on a diverse portfolio of resources to generate electricity;

       (3) Renewable and efficiency resources provide local economic development opportunities and local jobs in Washington;

       (4) Washington is blessed with an abundance of local renewable energy resources;

       (5) Washington has a long tradition of energy policies that support energy efficiency and renewable energy development. These policies have stimulated economic development, reduced operating costs for businesses, made industries more competitive, made homes more comfortable and efficient, reduced the energy burden of low-income households, and protected the environment;

       (6) Encouraging irrigators to increase the efficiency of their pumping operations will yield substantial benefits by reducing peak demands of both electricity and water supplies, improving farm economics, and maximizing use of water resources;

       (7) The Washington state electricity system study, commissioned by the fifty-fifth legislature through chapter 300, Laws of 1998, confirmed that changes in the electric industry have had the unintended consequence of shortening utility planning horizons and reducing incentives for electric utilities to invest in energy conservation and new renewable energy resources;

       (8) The study also found that there are significant energy conservation resources that cost the same or less than the least costly new electric generation options, and that while some nonhydroelectric renewable resources may not be cost-effective in the short term, they provide significant energy system and environmental benefits to warrant development;

       (9) The study also found that investment in low-income energy services is declining and unstable, although the percent of Washington's population below the poverty level has increased and low-income households pay a significantly higher percent of their incomes for energy than nonlow-income households; and

       (10) Fuel diversity, economic, and environmental benefits from renewable energy and efficiency resources accrue to the public at large, and therefore all consumers and retail suppliers have an equal obligation to support a minimum amount of these resources in the state's electric resource portfolio.

The department of labor and industries currently does not have an effective means of addressing these complaints in order to ensure workers are paid the wages they are owed.

       Finds that the Washington state minimum wage law and wage claim laws do not authorize adequate penalties against violators. To improve compliance, the department of labor and industries should be allowed to assess interest on back wages and impose civil penalties against employers who are found to be not in compliance with chapters 49.46 and 49.48 RCW.

        Specifies that the committee has the following powers and duties: (1) At least once a year, hear public testimony on the actual and potential impacts of international trade agreements and negotiations on Washington state and submit an annual report to the state trade representative's office and to the legislature regarding the public testimony;

        (2) Maintain active communication with the state trade representative's office, the United States trade representative's office, Washington's congressional delegation, the national conference of state legislatures, and any other bodies the committee deems appropriate regarding ongoing developments in international trade agreements and policy;

        Declares an intent to amend the shoreline management act to facilitate the implementation of guidelines that provide for review and amendment of local government shoreline master programs. To this end, the legislature affirms the schedule of time limits provided in RCW 90.58.080 for updating shoreline master programs by local governments and eliminates the limits on state funding of shoreline master program updating costs.

       Declares an intent that the state provide funding to local governments that is reasonable and adequate to accomplish the task of updating shoreline master programs, and consistent with the schedule for the local governments to adopt the updates of shoreline master programs.

       Provides that, except as specifically described in RCW 90.58.250 (1), nothing in this act is intended to alter the existing obligations, duties, and benefits provided by the shoreline management act to local governments and the department.

        Declares that it is important that Washington state take strong measures to develop and implement a recovery strategy for the southern resident orcas, working closely with governmental and nongovernmental organizations with scientific, management, and regulatory responsibilities throughout the Pacific Northwest.

        Directs the fish and wildlife commission to prepare a recovery plan for orca whale populations that are seasonally resident in Washington waters.

        Requires that the recovery plan shall be adopted by the fish and wildlife commission no later than June 30, 2005. Where plan elements require additional funding or additional statutory authority to implement, the fish and wildlife commission shall use its best efforts to make recommendations to the legislature by January 15, 2005.
