Using dogs for fighting.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Provides that any person who sells or purchases any dog (Canidae) with the intent that the dog shall be engaged in an exhibition of fighting with another animal is guilty of a gross misdemeanor punishable by imprisonment not to exceed one year, or by a fine not to exceed five thousand dollars, or by both fine and imprisonment.

       Declares that mere ownership or possession of any animal does not create a presumption that the animal is owned or possessed for any purpose prohibited under chapter 16.52 RCW.

Regulating structural pest inspectors.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Declares that it is prohibited for a business to conduct one or more complete wood destroying organism inspections without first having obtained a structural pest inspection company license from the department.

       Provides that the director shall require each applicant for a structural pest inspector license to demonstrate to the director the applicant's knowledge of applicable laws and regulations; structural pest identification and damage; and conditions conducive to the development of wood destroying organisms by satisfactorily passing a written examination for the classifications for which the applicant has applied prior to issuing the license.

        Declares it is unlawful for any business to conduct complete wood destroying organism inspections without having obtained a company license from the director.

        Provides that the director shall not issue a license to any individual who intends to act as a structural pest inspector until evidence of financial responsibility, required and described in this act, is furnished by the applicant or the business employing the applicant. Licensed commercial applicators that have met the requirements of RCW 17.21.160 and their licensed commercial operator employees are exempt from this financial responsibility requirement when performing specific wood destroying organism inspections. Public employees licensed to perform structural pest inspections are exempt from this licensing requirement when acting within their official capacities.

        Provides that, within two hundred days of the effective date of a rule that imposes additional requirements on businesses the violation of which subjects the business to a penalty, assessment, or administrative sanction, an agency identified in RCW 34.05.220(6) shall notify businesses affected by the rule of the requirements of the rule and how to obtain technical assistance to comply.

        Requires notification in the notice of proposed rule making under RCW 34.05.320 that a preliminary cost-benefit analysis is available. The preliminary cost-benefit analysis must fulfill the requirements of the cost-benefit analysis under this act. If the agency files a supplemental notice under RCW 34.05.340, the supplemental notice shall include notification that a revised preliminary cost-benefit analysis is available. A final cost-benefit analysis shall be available when the rule is adopted under RCW 34.05.360.

Modifying provisions of the Washington telephone assistance program.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Finds that: (1) It is in the public interest to take steps to mitigate the effects of these changes on low-income persons; and

        (2) Advances in telecommunications technologies, such as community service voice mail provide new and economically efficient ways to secure many of the benefits of universal service to low-income persons who are not customers of local exchange telephone service.

        Authorizes a discount on a community service voice mailbox that provides recipients with: (1) An individually assigned telephone number;

        (2) The ability to record a personal greeting; and

        (3) A secure private security code to retrieve messages.

        Directs the department to enter into an agreement with the department of community, trade, and economic development for an amount not to exceed eight percent of the prior fiscal year's total revenue for the administrative and program expenses of providing community service voice mail services. The community service voice mail service may include toll-free lines in community action agencies through which recipients can access their community service voice mailboxes at no charge.

Providing financial assistance for victims of domestic violence seeking protection orders.

        Provides that, in addition to any other relief authorized under chapter 10.14 RCW, the court may order that the respondent transfer, or otherwise provide, a specified amount of funds, as determined by the court, to the petitioner to provide temporary financial assistance to the petitioner if the court finds that such assistance is necessary. The court may order such a transfer of funds under this act only once per petition involving the petitioner and respondent. At any subsequent proceeding for dissolution, legal separation, or invalidity of the marriage, or any subsequent proceeding for the establishment or modification of child support or maintenance, the petitioner shall disclose the amount transferred under this act and the court or agency must consider that amount transferred in determining property distribution, support, or maintenance.

Facilitating transfer of a vehicle upon death.

       Provides that a sole owner of a motor vehicle or trailer, and multiple owners of a motor vehicle or trailer who hold their interest as joint tenants with right of survivorship or as tenants by the entirety, on application and payment of the fee required for an original certificate of ownership, may request the department to issue a certificate of ownership for the motor vehicle or trailer in beneficiary form that includes a directive to the department to transfer the certificate of ownership on death of the sole owner or on death of all multiple owners to one beneficiary or to two or more beneficiaries as joint tenants with right of survivorship or as tenants by the entirety named on the face of the certificate.

        Directs the joint legislative audit and review committee to evaluate the current status of the geoduck resource in Washington and report to the legislature by December 1, 2004. The report must: Include an update on the current harvest trends and policies to determine the sustainability of the geoduck harvest; include the role of aquaculture and reseeding in geoduck management and enforcement; and make recommendations for improving the health of the geoduck resource while maximizing economic benefits.

This effort shall include the coordination of: (1) The promotion of nature-based tourism;

        (2) The promotion of fishing, hunting, and wildlife viewing;

        (3) The creation of partnerships among agencies, organizations, tribes, and local communities to develop and promote nature-based tourism;

        (4) The provision of educational information to the minority and local communities in order to educate them about rules and regulations as well as recreational opportunities; and

(DIGEST OF PROPOSED 2ND SUBSTITUTE)

        Finds that it is in the best interest of the trust beneficiaries to capture additional revenues while providing for additional environmental protection on timber sales.

        Finds that contract harvesting is one method to achieve these desired outcomes.

        Directs the department of natural resources to establish and implement contract harvesting where there exists the ability to increase revenues for the beneficiaries of the trusts while obtaining increases in environmental protection.

        Requires the board of natural resources to determine whether any special appraisal practices are necessary for logs sold by the contract harvesting processes, and if so, to adopt the special appraisal practices or procedures.

        Requires the board of natural resources to establish and adopt policy and procedures by which the department evaluates and selects certified contract harvesters. The procedures must include a method whereby a certified contract harvester may appeal a decision by the department or board of natural resources to not include the certified contract harvester on the list of approved contract harvesters.

        Requires the department of natural resources to provide a report to the appropriate committees of the legislature concerning the costs and effectiveness of the contract harvesting program. The report must be submitted by December 31, 2006.

        Declares an intent that by 2006, there will be a fully functioning state program for confined animal feeding operations in the state, and that this program will be a single program for all livestock sectors.
