Criminalizing interference with certain mining rights and activities.

 

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

 

       Declares that a person commits the crime of mineral trespass if the person intentionally and without the permission of the claim holder: (1) Enters a mining claim posted as required in chapter 78.08 RCW and disturbs, removes, or attempts to remove any mineral from the claim site;

       (2) Tampers with or disturbs a flume, rocker box, bedrock sluice, sluice box, dredge, quartz mill, or other mining equipment at a posted mining claim; or

       (3) Defaces a location stake, side post, corner post, landmark, monument, or posted written notice within a posted mining claim.

       Declares that mineral trespass is a gross misdemeanor.

       Declares that a person commits the crime of interfering with a lawful small scale mining operation that is in full compliance with state and federal laws if the person intentionally: (1) Interferes with a lawful small scale mining operation; or

       (2) Stops, or causes to be stopped, a lawful small scale mining operation.

       Provides that interfering with a lawful small scale mining operation is a gross misdemeanor.

Providing courses of study options in public high schools.

 

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

 

       Provides that all school districts with public high schools shall provide, directly or in cooperation with a community or technical college, a skills center, an apprenticeship committee, or another school district, the opportunity for students to take the following courses of study: (1) A course of study for students whose educational plans include application for entrance to a baccalaureate-granting institution after being granted a high school diploma. The program shall help these students to meet at least the minimum entrance requirements under RCW 28B.10.050;

       (2) A course of study for students whose educational plans include the pursuit of a professional or technical certificate or degree that requires less than four years of postsecondary education; and

       (3) A course of study for students who are planning to defer further educational plans and enter the world of work upon graduation from high school.


        Provides that the courses of study provided under this act shall: (1) Help students demonstrate the application of essential academic learning requirements to the world of work, occupation-specific skills, knowledge of more than one career within their chosen pathway, and employability and leadership skills; and/or

        (2) Help students demonstrate the knowledge and skill needed to prepare for industry certification upon completion of the program, and/or have the opportunity to articulate to postsecondary education and training programs related to their secondary program.

Modifying the scope of care provided by physical therapists.

 

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

 

        Declares that the purpose of this act is to protect the public health, safety, and welfare, and to provide for state administrative control, supervision, licensure, and regulation of the practice of physical therapy.

        Declares an intent that only individuals who meet and maintain prescribed standards of competence and conduct be allowed to engage in the practice of physical therapy as defined and authorized by this act.

        Declares it is unlawful for any person to practice or in any manner hold himself or herself out to practice physical therapy or designate himself or herself as a physical therapist, unless he or she is licensed in accordance with this act.

        Provides that physical therapists are responsible for patient care given by assistive personnel under their direct supervision. A physical therapist may delegate to assistive personnel and supervise selected acts, tasks, or procedures that fall within the scope of physical therapy practice but do not exceed the education or training of the assistive personnel.

        Declares that nothing in this act may be construed to prohibit other licensed health care providers from using the services of physical therapist assistants, physical therapist aides, or other assistive personnel as long as the licensed health care provider is responsible for the activities of such assistants, aides, and other personnel and provides appropriate supervision.

Levying an assessment on certain agricultural plants.

 

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

 

       Provides that the annual assessment for horticultural plants of the genera Chaenomeles, Cydonia, Craetagus, Malus, Prunus, Pyrus, and Sorbus established under this act may be increased in excess of the fiscal growth factor as provided in RCW 43.135.055 for the fiscal year ending June 30, 2004.

       Provides that the act shall be null and void if appropriations are not approved.

       Clarifies that building operation and maintenance costs of housing projects or units within housing projects eligible to receive housing trust funds, that are affordable to very low-income persons with incomes at or below fifty percent of the area median income, are eligible for local funds.

       Declares an intent to provide policy tools to assist the institutions of higher education in managing overenrollment of students, including students who may be enrolling in Washington institutions with resident status who should be considered nonresidents.

       Declares an intent to encourage students to make prudent choices and maximize the taxpayer investment in supporting their higher education. Students who are not making wise use of the opportunities provided by public institutions of higher education should not expect public support of their education to continue indefinitely.

Providing property tax exemptions for nonprofit organizations supporting artists.

        Provides that the real and personal property owned or used by a nonprofit organization is exempt from taxation if the property is used for solicitation or collection of gifts, donations, or grants for the support of individual artists and the organization meets all of the following conditions: (1) The organization is organized and conducted for nonsectarian purposes.

        (2) The organization is qualified for exemption under section 501(c)(3) of the federal internal revenue code.

        (3) The organization is governed by a volunteer board of directors of at least eight members.

        (4) The gifts, donations, and grants are used by the organization for grants, fellowships, information services, and educational resources in support of individual artists engaged in the production or performance of musical, dance, artistic, dramatic, or literary works.

Preventing the use of law enforcement profiling on the basis of whether a person is riding a motorcycle or wearing motorcycle-related paraphernalia.

        Requires local law enforcement agencies to: (1) Adopt a written policy designed to condemn and prevent motorcycle profiling;

        (2) Review and audit their existing procedures, practices, and training to ensure that they do not enable or foster the practice of motorcycle profiling;

        (3) Institute training to address the issues related to motorcycle profiling. Officers should be trained in how to better interact with persons they stop so that legitimate police actions are not misperceived as motorcycle profiling; and

       (4) Work with the motorcycle groups in their communities to appropriately address the issue of motorcycle profiling.

       Directs the Washington Association of Sheriffs and Police Chiefs to coordinate with the criminal justice training commission to ensure that issues related to motorcycle profiling are addressed in basic law enforcement training and offered in regional training for in-service law enforcement officers at all levels.

       Declares that counties have the power to declare by ordinance what shall be deemed nuisances within the county; to prevent, remove, and abate nuisances at the expense of the parties creating, causing, or committing or maintaining them; and to levy a special assessment on the land or premises on which the nuisance is situated to defray the cost, or to reimburse the county for the cost of abating it, and this assessment shall constitute a lien against the property which shall be of equal rank with state, county, and municipal taxes.

        Declares that no person conducting business in the state may initiate or assist in the transmission of an electronic commercial text message to a telephone number assigned to a Washington resident for cellular telephone or pager service that is equipped with short message capability or any similar capability allowing the transmission of text messages.

        Declares it is not a violation of this act if: (1) The commercial electronic text message is transmitted at the direction of a person offering cellular telephone or pager service and the subscriber has elected to receive these text messages;

        (2) The commercial electronic text message is transmitted by a person that has an existing business relationship with the subscriber and the subscriber has elected to receive these text messages; or

        (3) The commercial electronic text message is transmitted by an affiliate of a person who has an existing business relationship with the subscriber and the subscriber has provided consent to the person with whom he or she has an existing business relationship to receive these messages from affiliates of the person.

A program under this act shall be designed to incorporate financial education throughout the curriculum for grades kindergarten through twelve and shall be based on the concept of achieving financial literacy through the teaching of personal financial management skills and the basic principles involved with earning, spending, saving, and investing.

Establishing requirements for state agency contracts with pharmaceutical benefit management companies.

       Provides that any contract between the administrator or any other agency administering a state purchased health care program and a pharmacy benefit management company must include the following provisions: (1) Disclosure of any agreements between the pharmacy benefit management company and a pharmaceutical manufacturer, its contractors, or an affiliate of a pharmaceutical manufacturer related to the use of that pharmaceutical manufacturer's products. Agreements to be disclosed include but are not limited to: (a) Agreements for the submission of data to pharmaceutical manufacturers or their contractors and any remuneration received from the manufacturer for supplying the data; (b) Rebate agreements or contracts with pharmaceutical manufacturers related to use of that manufacturer's products or the use of another manufacturer's products; (c) Payments by a drug manufacturer to the pharmacy benefits management company for switching consumer purchases to a drug produced or distributed by that pharmaceutical manufacturer; and (d) Any other payment to the pharmacy benefit management company by a pharmaceutical manufacturer or its contractors; and

       Creates the special services pilot program. The purpose of the program is to encourage participating school districts to provide early intensive reading and language assistance to students who are struggling academically. The goal of such assistance is to effectively address reading and language difficulties resulting in a substantially greater proportion of students meeting the progressively increasing performance standards for both the aggregate and disaggregated subgroups under federal law. The pilot program will remove the financial disincentive that will occur if the number of students eligible for specialized programs is reduced as a result of this effective early intervention.

       Provides that, by December 15, 2007, the superintendent of public instruction shall submit a report to the governor and legislature that summarizes the effectiveness of the pilot program. The report shall also include a recommendation as to whether or not the pilot program should be continued, expanded, or otherwise modified.

        Expires June 30, 2010.

       Provides that a person detained and taken into custody under this act by a county designated mental health professional or a peace officer shall not be charged with assault if physically resisting under diminished capacity conditions and at least one of the following conditions is present: (1) Proper and adequate crisis intervention training for detaining a person with mental illness was not provided to the detaining person;

       (2) No permanent bodily harm was done to the detaining person;

       (3) The detainee was psychotic at the time he or she was taken into custody;

       (4) The detainee was acting in a defensive manner; or

       (5) The detainee was not armed.

       (2) Makes a good faith effort to verify the information contained in the certification provided by the prospective consumer pursuant to this act against a commercially available data base, or obtains a photocopy or other image of the valid, government-issued identification stating the date of birth or age of the individual placing the order;

       (3) Provides to the prospective consumer, via e-mail or other means, a notice that meets the requirements of this act;

       (4) In the case of an order for cigarettes pursuant to an advertisement on the internet, receives payment for the delivery sale from the prospective consumer by a credit or debit card that has been issued in the consumer's name or by check.

       Provides that the amount of revenue used for maintenance and operations of parks and recreational facilities may not exceed twenty-five percent of the total amount collected from the tax levied under RCW 84.34.230 in the preceding calendar year. Revenues from this tax may not be used to supplant existing maintenance and operation funding. Any rights or interests in real property acquired under this act must be located within the assessing county.

       Provides that in counties with a population of five hundred thousand or more, the board of county commissioners or county legislative authority shall develop a process to ensure a distribution of conservation futures funds, over time, throughout the county.

        Creates the parks and outdoor recreation lands investment account in the state treasury. Money placed in the account includes tax receipts identified for this purpose under RCW 82.49.030, and any other money appropriated to the account by the legislature.

        Provides that expenditures from the account may be used only for operation, maintenance, and capital improvements of state parks and outdoor recreation lands, and appropriated as follows: (1) Twenty percent to the department of fish and wildlife;

        (2) Twenty percent to the department of natural resources; and

        (3) Sixty percent to the state parks and recreation commission. The percentage appropriated to the state parks and recreation commission must be reduced by the estimated amount to be collected during the biennium from a vehicle parking permit.

        Provides that an excise tax is imposed for the privilege of using a motor home, travel trailer, or camper in this state, except those exempt under this act.

        Declares that the annual amount of the excise tax for a motor home, travel trailer, or camper in this act is eight-tenths of one percent of fair market value.

        Provides that, when a public utility district provides wholesale telecommunications services, it shall create a separate utility function for the provision of such services and shall separately account for the revenues, expenses, property, allocation of costs to its internal telecommunications needs, and the amount of funds required from other utility functions to support the provision of wholesale telecommunications services.

        Provides that a public utility district providing wholesale telecommunications services shall submit a report to the appropriate committees of the legislature by December 1st of the first year of each biennium. The report must include, at a minimum: (1) A description of all activities relating to the construction, acquisition, operation, marketing, and leasing of telecommunications facilities and wholesale telecommunications services; and

        (2) A description of the number of new locations connected to the telecommunications facilities resulting from the provision of wholesale telecommunications services to internet service providers and entities authorized to provide telecommunications services to the general public.

        Finds, also, that local business and occupation tax revenue provides a sizable portion of city revenue that is used for essential services.

        Recognizes that local government services contribute to a healthy business climate.

        Declares an intent to provide for a more uniform system of city business and occupation taxes that eliminates multiple taxation, while allowing for some continued local control and flexibility to cities.

       Provides that the standards shall include methods for measuring success factors following treatment. The standards shall include, but not be limited to, continued use of alcohol or controlled substances, arrests, violations of terms of community supervision, and convictions for subsequent offenses. These standards shall be utilized by the court in determining the continued use of this alternative and the success of treatment providers and programs.

Concerning prescription drug assistance programs for seniors.

       Declares an intent to develop programs to provide prescription drugs at an affordable price to those in need, and increase public awareness regarding their safe and cost-effective use.


        Establishes a program to be known as the medicaid senior prescription drug program.

        Directs the department to obtain necessary federal waivers to implement the medicaid senior prescription drug program. Consistent with federal waiver conditions, the department may charge enrollment fees, premiums, or point-of-service cost-sharing to enrollees of the program.

        Declares that eligibility for this program is limited to persons: (1) Who are age sixty-five and older;

        (2) Whose family income does not exceed one hundred fifty percent of the federal poverty level as adjusted for family size and determined annually by the federal department of health and human services;

        (3) Who do not otherwise have insurance that provides prescription drug coverage; and

        (4) Who otherwise are eligible under Title XIX and the state's federal prescription drug waiver program.

        Directs the health care authority to implement a program whereby it negotiates with prescription drug manufacturers for price discounts, comparable to those negotiated for its preferred prescription drugs, to be available to any Washington resident as indicated.

        Requires each of the state's area agencies on aging to implement a program intended to inform and train persons sixty-five years and older in the safe and appropriate use of prescription and nonprescription medications. To further this purpose, the department shall award a development grant of no more than five thousand dollars to each of the agencies upon a showing that: (1) The agency has the ability to effectively administer such a program, including an understanding of the relevant issues and appropriate outreach and follow-up;

        (2) The agency can bring resources to the program in addition to those funded by the grant; and

        (3) The program will be a collaborative effort between the agency and other health care providers and programs in the location to be served, including doctors, pharmacists, and long-term care providers.

        Provides that, by January 1, 2005, the administrator of the health care authority and the director of the department of social and health services shall submit to the governor and the legislature a progress report regarding the implementation of the programs created in this act.

Preventing the spread of animal diseases.

        Provides that the director may issue a quarantine order and enforce the quarantine of any animal or its reproductive products when any animal or its reproductive products are affected with or have been exposed to disease or when there is reasonable cause to investigate whether any animal or its reproductive products are affected with or have been exposed to disease, either within or outside the state. Overt disease or exposure to disease in any animal or its reproductive products need not be immediately obvious for a quarantine order to be issued or enforced. The quarantine shall remain in effect as long as the director deems necessary.

        Provides that, where disease or contamination is suspected, the director may seize those items necessary to conduct the tests, inspections, or examinations.

        Provides that if the director is denied access to the animal premises or the animals for purposes of conducting tests, inspections, or examinations or the animal owner fails to comply with an order of the director, the director may apply to a court of competent jurisdiction for an administrative search warrant.

       Finds cost-effective protection for all state waters to be superior to a single tug, single location approach.

       Requires the department of ecology to prepare the following reports by October 1, 2003: (1) A summary of all drift groundings within Washington waters of commercial vessels over three hundred gross tons that have resulted in oil releases and that addresses the potential mitigation of tug use during each of the oil spill incidents.

       (2) A review of all current state prevention activities that lists in order of priority where tug mitigation funding ranks and whether current resources need to be reprogrammed to fund such activities.

       (3) The department shall work with the office of the attorney general and the United States coast guard to list all potential uses of oil pollution act of 1990 funding for the mitigation benefits of targeted tug use.

       (4) The department shall work with the office of the attorney general to list all past uses of the state-funded Neah Bay tug that were candidates for salvage claim awards.

The highest priority programs must be evaluated to determine if they are operating at maximum efficiency, while the lowest priority programs must be assessed to determine their continued viability;

        (4) Fair, independent, professional performance audits of state agencies by the state auditor are essential to improving the efficiency and effectiveness of government.

        Provides that the act shall be null and void if appropriations are not approved.

        Finds that sport shooting ranges in this state offer valuable hunter and firearm safety training, legitimate and important forms of recreation to the general public, and provide the opportunity for many law enforcement agencies to maintain necessary firearms skills efficiently and at little or no cost.

        Finds that the continued existence and viability of sport shooting ranges is impacted by burdensome retroactive regulation and lawsuits, thereby potentially threatening the availability of low-cost firearms training to some local law enforcement agencies, as well as hunter and firearms safety training and recreation to the general public.

        Provides that, notwithstanding any other provision of law, a person who operates or uses a sport shooting range in this state is not subject to civil liability or criminal prosecution in a matter relating to noise or noise pollution resulting from the operation or use of the range if the range is in compliance with any noise control laws or ordinances that applied to the range and its operation at the time of construction or initial operation of the range.
