Concerning the direct retail sale of salmon, crab, and sturgeon.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Provides that the commission may require that the holder of a direct retail endorsement notify the department up to eighteen hours before conducting an in-person sale of retail-eligible species, except for in-person sales that have a cumulative retail sales value of less than one hundred fifty dollars in a twenty-four hour period that are sold directly from the vessel.

Creating a building mapping information system.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Recognizes the extreme dangers present when the safety of our citizens requires first responders such as police and fire fighters to evacuate and secure a building. In an effort to prepare for responding to unintended disasters, criminal acts, and acts of terrorism, the legislature intends to create a statewide first responder building mapping information system that will provide all first responders with the information they need to be successful when disaster strikes.

       Requires that, when funded, the Washington Association of Sheriffs and Police Chiefs shall create and operate a statewide first responder building mapping information system.

       Requires the Washington association of sheriffs and police chiefs in consultation with the Washington state emergency management office, the Washington state fire commissioner's office, and the state patrol to convene a committee to establish guidelines related to the statewide first responder building mapping information system.

        Directs the secretary of state to adopt rules and establish standards for voting technology and systems used by the state or any political subdivision to be accessible for individuals with disabilities, including nonvisual accessibility for the blind and visually impaired, in a manner that provides the same opportunity for access and participation, including privacy and independence, as other voters.

Creating a geoduck management task force.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Creates a legislative task force to study and make recommendations regarding geoduck management and harvest rules.

        Provides that, by December 1, 2003, the task force established in this act must report to the legislature with recommendations concerning the following issues: (1) Improvements for the coordinated management of the geoduck resource;

        (2) The costs and benefits of implementing a limited entry geoduck diver license;

        (3) Improvements for compliance and enforcement with geoduck harvest rules on state and nonstate-owned lands;

        (4) Improvements to state rules for geoduck harvesting; and

        (5) The state's potential role in aquaculture and reseeding of geoduck clams.

        Expires January 1, 2004.

Changing threshold property values for crimes against property.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Revises threshold property values for crimes against property.

       Directs the sentencing guidelines commission to conduct a study of threshold property values for crimes involving property. The commission shall include in the study at least the crimes of malicious mischief, theft, unlawful issuance of checks or drafts, theft of rental, leased, or lease-purchased property, and possessing stolen property, as well as any other property-based crimes other than those related to controlled substances in which the value of the property is an element of the offense. The commission shall: (1) Study the need for, and effect of, changes in threshold property values beyond those established in this act for crimes involving property; and

       (2) Identify viable mechanisms for establishing a periodic review or adjustment of such values, and whether a particular mechanism should be recommended to the legislature and governor.

       Provides that, in conducting the study, the commission shall seek the participation of the business community, prosecuting attorneys, defense attorneys, local governments, and the department of corrections.

       Requires the commission to report its findings and any recommendations to the legislature and the governor by December 1, 2004.

       Expires July 1, 2005.

Allowing advertising on bus shelters.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Authorizes local transit authority bus shelters within the right of way of the state highway system to display and maintain commercial advertisements subject to applicable federal regulations, if any. Pursuant to RCW 47.12.120, the department may lease state right of way air space to local transit authorities for this purpose, unless there are significant safety concerns regarding the placement of certain advertisements.

       Provides that advertisements posted on a local transit authority's bus shelter may not exceed twenty-four square feet on each side of the panel. Panels may not be placed on the roof or upstream side of the shelter.

Regulating special license plates.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Finds that there has been an increase in the demand from constituent groups seeking recognition and funding through the establishment of commemorative or special license plates. The high cost of implementing a new special license plate series coupled with the uncertainty of the state's ability to recoup its costs, has led the legislature to delay the implementation of new special license plates.

        Declares that, in order to address these issues, it is the intent of the legislature to create a mechanism that will allow for the evaluation of special license plate requests and establish a funding policy that will alleviate the financial burden currently placed on the state. Using these two strategies, the legislature will be better equipped to efficiently process special license plate legislation.

Requiring a plan to establish pilot regional correctional facilities.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Provides that, not later than December 31, 2003, the sentencing guidelines commission shall present to the legislature a plan for establishing pilot regional correctional facilities.

       Requires the plan for establishing pilot regional correctional facilities to include, but is not limited to, the following: (1) A plan for increasing the space availability in local and county jails for pretrial detainees;

       (2) An efficient and effective plan for joint use of total confinement beds by local and state government;

       (3) A description of proposed shared and/or revised jurisdiction and operational responsibility, including the possibility of establishing a regional corrections authority;

       (4) A summary of proposed changes to the criminal code reflecting revised housing jurisdiction;

       (5) A description of the inmate population eligible for placement in pilot regional correctional facilities;

       (6) A review of treatment services and programs intended to meet the needs of special populations including drug and substance abuse, mental health, and special medical needs;

       (7) An estimate of potential benefits to local and county jail operators and to the state, which could be realized by implementation of pilot programs;

       (8) A proposed method for identifying pilot regional correctional facility sites;

       (9) A methodology for evaluating the costs benefit of operation of pilot facilities; and

       (10) Recommendations for shared funding of the construction and operation cost of the facilities from state and local resources.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

       Provides that, whenever state officers or measures are voted upon at a state primary or general election held in an even-numbered year under RCW 29.13.010, the state of Washington shall assume a prorated share of the costs of the primary or election according to the following schedule: (1) 2004, twenty-five percent;

       (2) 2006, fifty percent;

       (3) 2008, seventy-five percent; and

       (4) 2010 and thereafter, one hundred percent.

Concerning the cost of a catch record card.

(DIGEST OF PROPOSED 1ST SUBSTITUTE)

        Provides that catch record cards necessary for proper management of the state's food fish and game fish species and shellfish resources shall be administered under rules adopted by the commission and issued at no charge for the initial catch record card and ten dollars for each subsequent catch record card.

        Provides that a duplicate catch record costs ten dollars and shall be available only to individuals holding a full season license. Catch record cards issued in conjunction with a temporary short-term license are not subject to the provisions of this act.

        Provides that charterboat operations issuing temporary short-term licenses shall affix a charterboat stamp to each catch record card issued before fishing commences. The funds received from the sale of catch record cards must be deposited into the wildlife fund.

        Directs the department of community, trade, and economic development to establish a competitive process to solicit proposals for and prioritize projects whose primary objective is to assist nonprofit youth organizations in acquiring, constructing, or rehabilitating facilities used for the delivery of nonresidential services, excluding outdoor athletic fields.

       Provides that the rate a city or town may charge under this act shall be reduced by a minimum of ten percent for any new or remodeled commercial building that utilizes the permissive rainwater harvesting system guidelines for nonresidential occupancies adopted by the Washington state building code council on July 12, 2002.

       Provides that no rate or charge imposed under this act may increase in any fiscal year by a percentage in excess of the fiscal growth factor for that fiscal year as determined under chapter 43.135 RCW.

Changing veterans' tuition waiver provisions.

       Provides that, subject to the limitations in RCW 28B.15.910, the governing boards of the state universities, the regional universities, The Evergreen State College, and the community colleges, shall waive all or a portion of tuition and fees for the following persons: (1) An eligible veteran or national guard member;

       (2) A child and the spouse of an eligible veteran or national guard member who became totally disabled as defined in RCW 28B.15.385 while engaged in active federal military or naval service, or who is determined by the federal government to be a prisoner of war or missing in action;

       (3) A child and the surviving spouse of an eligible veteran or national guard member who lost his or her life while engaged in active federal military or naval service. However, upon remarriage, the surviving spouse of an eligible veteran or national guard member is ineligible for a waiver under this act.

       Repeals RCW 28B.10.265, 28B.15.620, 28B.15.625, 28B.15.628, and 28B.15.629.

At the option of the eligible student, the institution shall either refund the total tuition and fees paid by the eligible student for the applicable academic term, or shall readmit the eligible student for one academic term under the following conditions: (1) The eligible student shall be exempt from the payment of additional tuition and fees;

        (2) No new course sections shall be created as a direct result of students receiving the waivers;

        (3) Enrollment information on students receiving the waivers shall be maintained separately from other enrollment information and shall not be considered in any enrollment statistics that would affect budgetary determinations; and

        (4) Institutions may apply to the legislature for a supplemental appropriation to cover the cost of serving any student who elects to exercise a reenrollment option under this act.

        Provides that, in a criminal or civil action brought by reason of a person having been detained on or in the immediate vicinity of the premises of an outdoor music venue or related campground for the purpose of pursuing an investigation or questioning by a law enforcement officer as to the lawfulness of the consumption or possession of alcohol or drugs, it is a defense to the action that the person was detained in a reasonable manner and for not more than a reasonable time to permit the investigation or questioning by a law enforcement officer, and that a peace officer, owner, operator, employee, or agent of the outdoor music venue had reasonable grounds to believe that the person so detained was committing or attempting to unlawfully consume or possess alcohol or drugs on the premises.

       Finds that there is a substantial disparity in bargaining power between motorsports vehicle manufacturers and their dealers, and that in order to promote the public interest and the public welfare, and in the exercise of its police power, it is necessary to regulate the relationship between motorsports vehicle dealers and motorsports vehicle manufacturers, importers, distributors, and their representatives doing business in this state, not only for the protection of dealers but also for the benefit for the public in assuring the continued availability and servicing of motorsports vehicles sold to the public.

Ensuring that offender populations do not exceed prison capacity.

        Declares an intent to: (1) Promote the primary purposes of the criminal justice system and focus resources on sex offenders and violent offenders who pose the greatest risk to our communities by reducing offender populations when such populations exceed the maximum operational capacity of facilities operated by the department of corrections; and

        (2) Accomplish the reduction by concentrating solely on offenders convicted of certain nonviolent offenses who are close to the end of their sentences.

        Requires the caseload forecast council, in consultation with the department of corrections, the sentencing guidelines commission, and the indeterminate sentence review board, to, by rule, establish a methodology for determining the maximum statewide operating capacity for correctional facilities operated by the department of corrections. The methodology must take into account methods for increasing facility capacity without making improvements or additions to infrastructure.

        Provides that an offender may be released by the department under this act. An offender released under this provision shall be on community custody status for the difference between the date of release and the expiration of the offender's term of confinement imposed by the court, subject to conditions imposed by the department. For an offender released from custody imposed because of a conviction for an offense under chapter 69.50 or 69.52 RCW, the community custody must include affirmative conditions relating to drug treatment.

       Finds that the intent to combine institutional flexibility and authority to make decisions at the local level with accountability for achieving statewide goals and objectives has never been fully achieved, in part because there has not been an operating mechanism through which to implement this relationship.

       Declares an intent to authorize performance contracts between the state and each public four-year institution of higher education, as well as a performance contract between the state and the community and technical college system. These performance contracts will constitute a negotiated agreement between the state and the governing boards of each institution and the community and technical college system where each party makes a multiyear commitment to operate under the terms of the agreement.

       Declares that it is through these performance contracts that the legislature intends to implement a new relationship between the state and its institutions of higher education, where the state's primary interest lies not in the management and operations of an institution, but in the institution's contribution to achieving agreed-upon statewide goals and objectives for higher education.

Requiring that vehicle dealers get proof that an unaccompanied test driver has a driver's license and motor vehicle liability insurance.

       Requires any vehicle dealer who allows a driver to test drive a motor vehicle without an employee of the vehicle dealer accompanying the driver to first require proof that: (1) The driver possesses a valid driver's license in accordance with RCW 46.20.001; and

       (2) The driver possesses motor vehicle liability insurance. For the purposes of this subsection, possession of an insurance identification card required under RCW 46.30.030 shall be considered proof of motor vehicle liability insurance. The vehicle dealer shall maintain, on file, a photocopy of the driver's license and insurance identification card.

       Provides that any violation of this act is a class 1 civil infraction under chapter 7.80 RCW.

       Declares that nothing in chapter 46.29 or 46.30 RCW, or Title 48 RCW shall be affected by this act.

        (2) Mandatory reductions of greenhouse gas emissions may eventually be imposed on Washington sources, and, consequently, the state has a responsibility to use its best efforts to ensure that organizations that voluntarily reduce their emissions receive appropriate consideration for reductions in emissions made before mandatory programs are implemented.

        (3) Past programs in the state that took early and responsible action to reduce pollution and to save energy have demonstrated political, economic, and technological leadership, have benefited the state, and have saved taxpayers, business owners, and homeowners significant amounts of money.

        (4) The state's tradition of environmental and energy leadership should be recognized by establishing a registry to provide documentation of reductions in greenhouse gas emissions that are voluntarily achieved by sources within the state.

        (5) Greenhouse gas emissions exchanges are being established with the ability to buy and sell the rights to emissions reduction credits. Washington sources will benefit as mature traders in these markets in the future by early participation.

        Declares that it is, therefore, the declared policy of this state to limit access to the highway facilities of this state in the interest of highway safety and for the preservation of the investment of the public in such facilities; however, approaches to partially controlled limited access highways shall be permitted for the deployment of personal wireless facilities.

Prohibiting a regional transit authority from implementing a light rail transit system in certain areas.

        Provides that a regional transit authority may not make any expenditure, incur any debt, issue any bonds, or enter into any agreement, for the purpose of implementing a light rail transit system in a county with a population over one million five hundred thousand persons.

        Provides that a regional transit authority may make expenditures under this act solely for the purpose of retiring debt, if any, relative to a light rail transit system that was incurred before the effective date of this act.

Specifying penalties for aircraft registration violations.

        Declares that a person in violation of RCW 47.68.230 is also subject to a penalty of four times the fees that are due.

        Provides that, in lieu of the penalties in this act, a violation of RCW 47.68.250 is a misdemeanor punishable and is subject to a penalty of one hundred dollars per aircraft for the first violation. Subsequent violations in the same year are subject to the following fines: (1) For the second violation, a fine of two hundred dollars per aircraft;

        (2) For the third and subsequent violations, a fine of four hundred dollars per aircraft.

        Declares that the revenue from penalties prescribed in this act and for a violation of RCW 47.68.230 must be deposited into the aeronautics account under RCW 82.42.090.

        Takes effect July 1, 2004.

Revising nursing home enforcement.

        Requires the department to identify factors to be considered in selecting the appropriate remedy to apply to a nursing home that has not complied with the licensing requirements under this chapter or chapter 74.42 RCW. In identifying the factors to be used in selecting an appropriate remedy, the department shall use a scope and severity method and assign the cited deficiencies to the appropriate category based on the scope and severity of a deficiency.

       Provides that the scope and severity factors identified by the department shall not exceed the federal factors for determining scope and severity of deficiencies cited under 1919(h) and 1819(h) of the federal social security act and 42 C.F.R. 488.404, as existing on January 1, 2003.

       Provides that, based on the determination of the scope and severity of the deficiency citation, the department shall apply penalties to the nursing home, as specified in RCW 18.51.060.

Requiring a fair announcement of concord grape prices.

       Declares that it shall be a violation of chapter 20.01 RCW for any agent, broker, cash buyer, commission merchant, dealer, or processor to purchase or receive, or attempt to purchase or receive, concord grapes grown in Washington for use by a processor in the commercial production of juice, jam, or jelly unless: (1) The processor sets forth a stated price in dollars and cents of all amounts paid or to be paid per unit thereof, and makes the stated price available to any selling or delivering party not later than the fifteenth day of August in the year in which such grapes are to be delivered;

       (2) Where a selling or delivering party has a contract for delivery of such grapes to a processor, the processor has, not later than the fifteenth day of August in the year in which such grapes are to be delivered, mailed to the delivering or selling party written notice of the stated grape price and opportunity to refuse to deliver with respect thereto; and

       (3) The processor has mailed to the director not later than the fifteenth day of August of each year in which such grapes are to be delivered, a written statement of the stated price to be paid for such grape or grapes.

Increasing the supply of dentists and dental hygienists to meet the critical shortage of dental providers in this state and underserved areas.

        Finds and declares that access to dental care is severely hampered by a critical and emergent shortage of dental providers in Washington state. Dental disease is an epidemic among poor children, the elderly, the disabled, and anyone who does not have access to adequate dental care.

        Finds that the lack of qualified dentists and dental hygienists poses a serious and compelling threat to the oral health of the people of this state.

        Declares that shortages are also due to licensing restrictions that have discouraged qualified dentists and dental hygienists from coming into this state. Increasing the number of dentists from other states and from military service would enable retiring dentists in this state to sell their practices to other qualified practitioners.
