On page 2, beginning on line 20 of the amendment, after "Sec. 2."
strike all material through "apply to:" on line 25 and insert "(1)
After July 1, 2007, no person may manufacture, knowingly sell, offer
for sale, or distribute for sale or use in this state products
containing a flame retardant that has not been subject to an
independent risk assessment and been found to be a technically feasible
and safer alternative to decabromodiphenyl ether.
(2) A manufacturer of products containing a flame retardant that
has been restricted under this section must, once the restriction takes
effect, notify persons that sell the manufacturer's products about the
provisions of this section.
(3) Subsections (1) and (2) of this section do not apply to:"

EFFECT: Repeals the ban on PBDEs and prohibits the manufacture and sale of flame retardants that have not been subject to an independent risk assessment and been found to be a technically feasible and safer alternative to deca-BDE.
