   On page 42, line 14, strike "claimant" and insert "prevailing party"

   On page 42, beginning on line 15, after "section," strike all material through "section," on line 18

   On page 43, beginning on line 4, after "(3)" strike all material through "(4)" on line 12

   Renumber the remaining subsections consecutively.

EFFECT: Removes from the offer of settlement provision the condition that a defendant is entitled to prevailing party attorneys' fees only if the defendant, within seven days of learning that the claimant suffered an unanticipated outcome, had made an apology or expression of sympathy and made assurances that remedial steps would be taken.
