   Strike everything after the enacting clause and insert the following:

 

   "NEW SECTION. Sec. 1. (1) The department of community, trade, and economic development and the department of revenue shall jointly conduct a study examining the feasibility of funding mechanisms that may be developed for providing municipal services to annexed areas. The study shall include, but is not limited to, consideration of funding mechanisms that:

   (a) Authorize county road districts to include incorporated territory within cities or towns;

   (b) Authorize county road property taxes imposed within an incorporated area of a county road district to be made available to and expended by a city or town for municipal services in annexed areas, subject to voter approval;

   (c) Require the completion of an interlocal agreement by the applicable jurisdictions;

   (d) Limit the duration of authorized transfers and expenditures;

   (e) Limit authorized expenditures to incorporated areas from which the county road property taxes were imposed; and

   (f) Include provisions for preserving revenues utilized by county sheriffs.

   (2) The department of community, trade, and economic development and the department of revenue shall report joint findings and recommendations to the appropriate committees of the senate and the house of representatives by June 30, 2007.

   (3) This section expires June 30, 2007."

 

   Correct the title.

 

 

 

EFFECT: Requires the Department of Community, Trade, and Economic Development (DCTED) and the Department of Revenue (DOR) to jointly conduct a study examining the feasibility of funding mechanisms that may be developed for providing municipal services to annexed areas. Specifies provisions for the study. Requires the DCTED and the DOR to report joint findings and recommendations to the appropriate committees of the senate and the house of representatives by June 30, 2007, the expiration date of the provision requiring the study.
