HB 3261 - H AMD 716

By Representative O’Brien

ADOPTED 2/10/2006

On page 4, line 7, after "shall" strike all material through "board" on line 9 and insert "provide opportunities for the victims of any crimes for which the offender has been convicted to present oral, video, written, or in-person testimony to the board. The procedures for victim input shall be developed by rule. To facilitate victim involvement, county prosecutor's offices shall ensure that any victim impact statements and known contact information for victims of record are forwarded as part of the judgment and sentence"

EFFECT: Requires the board to "provide opportunities" for the victim to provide input instead of "make reasonable efforts" to do so. Allows victims of any crimes for which the offender has been convicted to provide input, instead of the victims of the offender's "crime of conviction." Allows a victim to present video or in-person testimony, in addition to oral or written testimony, to the board. Allows the board to set the procedures for victim input by rule. Requires county prosecutors to ensure that any victim impact statements and known contact information for victims of record are forwarded as part of the judgment and sentence.
