On page 1, after line 16, strike all of section 2 and insert the following:
"NEW SECTION. Sec. 2. A new section is added to chapter 81.44 RCW to read as follows:
The Washington utilities and transportation commission shall conduct a study of hazardous materials handling throughout the state, with particular attention to the resolution of significant safety issues and the most effective means of enforcing current state and federal standards. The commission shall report to the transportation committees of the legislature by December 1, 2006, on options, strategies and recommendations for resolving significant safety issues and improving enforcement of current standards."
EFFECT: Removes language authorizing Utilities and Transportation Commission employees, certified by the Federal Railroad Administration, to conduct inspections, investigations or surveillance on the property of businesses involved in the transportation of hazardous materials by rail. Requires the Utilities and Transportation Commission to conduct a study of hazardous materials handling and report to the Legislature with recommendations for resolving significant safety issues and improving enforcement of current standards.
