   On page 22, line 8, after "(2)" strike all material through "operated facility" and insert the following:

   "((The facility shall be a publicly-owned and operated facility))The department shall solicit private and public sector proposals for a design, build, and operate contract for construction and operation of the new prison. The office of financial management must be consulted in the preparation of the solicitation and shall review and approve the selected proposal"

   On page 22, after line 23, insert the following:

   "(6) The department shall report on the results of the request for proposal solicitation to the Governor and the appropriate committees of the legislature prior to the allotment of funds for the project by the office of financial management. The report shall include information on the project contract finalists and the proposed project construction and operational costs."

EFFECT: Removes language specifying that the prison will be publicly-owned and operated. Requires the Department of Corrections to solicit private and public sector proposals for a design, build, and operate contract for construction and operation of the prison. Requires a report back to the Governor and the Legislature on the results of the project solicitation.
