Beginning on page 4, line 18 of the amendment, strike all of sections 5, 6, and 7 and insert the following:
"NEW SECTION. Sec. 5 By December 31st of each year, the
department and the department of health shall publish a report
identifying safer, technically feasible alternatives to commercial
decabromodiphenylether for use in the state of Washington. This report
shall include the relative measurements of persistence, toxicity, and
bioaccumulation upon which the determination was made that the
identified alternative is safer for human health and the environment.
The report shall also include the analysis of market availability and
price of the alternative upon which the determination that the
alternative is technically feasible is made, along with the analysis of
the economic viability of products containing these alternatives based
on the price differential between commercial decabromodiphenylether and
the identified alternative. If no safer, technically feasible
alternatives are identified in the report, the department shall by rule
grant an exemption to the ban such that a ban may not take effect until
four years after the identification of safer, technically feasible
alternatives to commercial decabromodiphenylether."
Renumber the remaining sections consecutively and correct any internal references accordingly.
