Background:
A cemetery district is authorized to acquire, establish, maintain, manage, improve, and
operate cemeteries. A cemetery district may include within its boundaries any incorporated
lands from a city or town with a population of less than 10,000, and thus acquire any
cemetery or cemeteries maintained and operated by any such city or town.
A cemetery district may not, however operate a cemetery within the corporate limits of a city
or town where a private, for-profit cemetery operates.
Summary of Bill:
The population limit prohibiting cemetery districts from including incorporated lands within
their districts from cities or towns with 10,000 or more residents is removed.
Appropriation: None.
Fiscal Note: Not requested.
Effective Date: The bill takes effect 90 days after adjournment of session in which bill is passed.
Testimony For: Allowing cemetery districts to include any incorporated lands from a city or town is rather straightforward and important.
