Brief Summary of Bill
  • Removes a population threshold, thereby allowing cemetery districts to include any incorporated territory within their boundaries, subject to certain limitations.

Background:

A cemetery district is authorized to acquire, establish, maintain, manage, improve, and operate cemeteries. A cemetery district may include within its boundaries any incorporated lands from a city or town with a population of less than 10,000, and thus acquire any cemetery or cemeteries maintained and operated by any such city or town.

A cemetery district may not, however operate a cemetery within the corporate limits of a city or town where a private, for-profit cemetery operates.

Summary of Bill:

The population limit prohibiting cemetery districts from including incorporated lands within their districts from cities or towns with 10,000 or more residents is removed.

Effective Date: The bill takes effect 90 days after adjournment of session in which bill is passed.
