Background: A person convicted of two of the crimes listed in Washington's two-strikes law
must be sentenced to life in prison without the possibility of release.
Chapter 436, Laws of 2005 prohibits an offender sentenced for a two-strikes offense against a
minor victim from living within 880 feet (two blocks) of a public or private school. The
Department of Corrections (DOC) and local law enforcement agencies are immune from liability
if they make a good faith effort to comply with this law.
The provisions of Chapter 436, Laws of 2005 terminate on July 1, 2006.
Summary of Bill: The residential restriction that applies to persons sentenced for a two-strikes offense against a minor, as well as the immunity provision set out in Chapter 436, Laws of 2005, supersede and preempt the laws of all local governments regarding the same subject matter.
