     AN ACT Relating to creating the association of Washington generals; amending RCW 43.04.040 and 43.04.100; and adding a new section to chapter 43.31 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION.  Sec. 1   A new section is added to chapter 43.31 RCW to read as follows:
     (1) The association of Washington generals is organized as a private, nonprofit, nonpartisan, corporation in accordance with chapter 24.03 RCW and this section.
     (2) The purpose of the association of Washington generals is to:
     (a) Provide the state a means of extending formal recognition for an individual's outstanding services to the state; and
     (b) Bring together those individuals to serve the state as ambassadors of trade, tourism, and international goodwill.
     (3) The association of Washington generals may conduct activities in support of their mission, including but not limited to:
     (a) Establishing selection criteria for selecting Washington generals;
     (b) Operating a statewide essay competition;
     (c) Training Washington generals as ambassadors of the state of Washington, nationally and internationally; and
     (d) Promoting Washington generals as ambassadors of the state of Washington.
     (4) The association of Washington generals is governed by a board of directors. The board is composed of the governor, lieutenant governor, and the secretary of state, who serve as ex officio, nonvoting members, and other officers and members as the association of Washington generals designates. The board shall:
     (a) Review nominations for and be responsible for the selection of Washington generals; and
     (b) Establish the title of honorary Washington general to honor worthy individuals from outside the state of Washington.
     (5) The lieutenant governor's office may provide technical and financial assistance for the association of Washington generals.
     (6) The legislature may make appropriations in support of the Washington generals subject to the availability of funds.

Sec. 2   RCW 43.04.040 and 1988 c 120 s 4 are each amended to read as follows:
     (1)(a) The secretary of state may authorize the use of the state seal on commemorative and souvenir items, and for historical, educational, and civic purposes. Such authorization shall be in writing.
     (((2))) (b) Application for such authorization shall be in writing and shall be accompanied by a filing fee, the amount of which shall be determined by the secretary of state. The secretary shall set the fee at a level adequate to cover the administrative costs of processing the applications.
     (((3))) (c) If the secretary determines that a permitted use of the seal could financially benefit the state, the secretary may condition authorization upon a licensing agreement to secure those benefits for the state.
     (((4))) (2) The secretary of state shall enter into an agreement with the office of lieutenant governor regarding the use of the state seal to support the operations of the association of Washington generals.
     (3)
The secretary of state shall adopt rules under chapter 34.05 RCW to govern the use of the seal in a manner consistent with this chapter. Any rule governing the use of the seal shall be designed to prevent inappropriate or misleading use of the seal and to assure tasteful and high-quality reproduction of the seal. The rules shall also prescribe the circumstances when a licensing arrangement shall be required and the method for determining licensing fees.

Sec. 3   RCW 43.04.100 and 1988 c 120 s 10 are each amended to read as follows:
     (1) Except under subsection (2) of this section, all fees, penalties, and damages received under this chapter shall be paid to the secretary of state and with the exception of the filing fee authorized in RCW 43.04.040(2) shall be deposited by the secretary into the capitol building construction account in the state treasury, for use in the historical restoration and completion of the legislative building.
     (2) Subject to the terms of the agreement under RCW 43.04.040, the association of Washington generals may retain the revenue generated by its activities involving the use of the state seal.
