AN ACT Relating to electronic monitoring of sex offenders; adding a new section to chapter 72.09 RCW; and creating a new section.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 A new section is added to chapter 72.09 RCW
to read as follows:
(1) County sheriffs shall select sex offenders within their county
to be electronically monitored with passive global positioning system
technology. Selection of which offenders to monitor shall be at the
judgment of the sheriff, but in making the determinations, the sheriff
shall consider:
(a) An offender's risk assessment from the department of
corrections;
(b) An offender's risk level classification and likelihood of
reoffense;
(c) Whether an offender is under community supervision;
(d) Whether an offender is registered as homeless; and
(e) Whether an offender committed a sex offense against a minor.
(2) Funds shall be distributed to counties based on the percentage
of total registered sex offenders in Washington state that reside in
each county.
NEW SECTION. Sec. 2 If specific funding for the purposes of this
act, referencing this act by bill or chapter number, is not provided by
June 30, 2006, in the omnibus appropriations act, this act is null and
void.
