AN ACT Relating to prohibiting the unauthorized sale of cell phone numbers; adding a new section to chapter 9.26A RCW; and prescribing penalties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 A new section is added to chapter 9.26A RCW
to read as follows:
(1) No person shall buy or sell the telephone number or call record
of any subscriber of a radio communications service company without the
written or electronic permission of the subscriber.
(2) A subscriber may revoke the permission in subsection (1) of
this section in writing or electronically. The revocation becomes
effective fifteen days after being sent.
(3) This section does not apply to the provision of telephone
numbers for the purposes indicated in RCW 19.250.010(4).
(4) A single violation of this section is a gross misdemeanor.
Each subsequent violation of this section, whether alleged in the same
or in subsequent prosecutions, is a class C felony punishable according
to chapter 9A.20 RCW.
(5) For the purposes of this section, "radio communications service
company" has the meaning provided in RCW 80.04.010.
