     TO THE HONORABLE GEORGE W. BUSH, PRESIDENT OF THE UNITED STATES, AND TO THE PRESIDENT OF THE UNITED STATES SENATE, AND TO THE UNITED STATES SENATORS FROM THE STATE OF WASHINGTON:
     We, your Memorialists, the Senate and House of Representatives of the State of Washington, in legislative session assembled, respectfully represent and petition as follows:
     WHEREAS, Article II, Section 2 of the United States Constitution states the President "... shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the United States ..."; and
     WHEREAS, There is a high likelihood of at least one vacancy on the United States Supreme Court during the 109th Congress; and
     WHEREAS, There is a possibility of the need to elevate a sitting justice on the United States Supreme Court to the position of Chief Justice during the 109th Congress; and
     WHEREAS, Activist judges on some federal courts have frustrated the constitutional structure which prescribes that laws shall be written by elected legislatures; and
     WHEREAS, President George W. Bush has expressed his commitment to appoint federal judges who will strictly interpret the United States Constitution; and
     WHEREAS, In the past, a minority of Senators have used dilatory tactics to prevent a Senate floor vote on several of President George W. Bush's judicial nominees, all of whom were reported favorably by the United States Senate Committee on the Judiciary;
     NOW, THEREFORE, Your Memorialists respectfully pray that our United States Senators move quickly to confirm all nominations by President George W. Bush to the United States Supreme Court.
     BE IT RESOLVED, That copies of this Memorial be immediately transmitted to the Honorable George W. Bush, President of the United States, the President of the United States Senate, and each member of the United States Senate from the State of Washington.
