   On page 22, after "(3)" on line 12, insert the following:

   "If an offender is accused of violating any condition or requirement of community custody, and is placed in total confinement due to the violation, the offender may not be released due to a lack of bed space.

   (4)"

   Renumber the subsections consecutively and correct the internal references accordingly.

EFFECT: Prohibits an offender who is placed in total confinement due to a violation of any condition or requirement of community custody from being released due to a lack of bed space.
