Brief Description: Removing the reference to theft of a motor vehicle in the first degree from RCW 13.40.210.

Brief Summary of Bill
  • Corrects reference to theft of a motor vehicle in the first degree and changes it to theft of a motor vehicle within the Juvenile Justice Act.

Background:

In 2007, the Legislature passed E3SHB 1001. The bill amended and restructured provisions that dealt with crimes involving auto theft for both adult and juvenile offenders. One crime enacted under the bill was theft of a motor vehicle; however, it did not create multiple degrees for this offense. Theft of a motor vehicle is a seriousness level II, class B felony offense for adult offenders and a category B offense for juvenile offenders.
   
The bill also required parole for offenders who receive a juvenile residential commitment sentence of theft of a motor vehicle 1, possession of a stolen motor vehicle, or taking a motor vehicle without permission 1.

Summary of Bill:

A reference to theft of a motor vehicle in the first degree is corrected and changed to theft of a motor vehicle in a section within the Juvenile Justice Act.

Appropriation: None.

Fiscal Note: Not requested.

Effective Date: The bill takes effect 90 days after adjournment of session in which bill is passed.
